MEMORANDUM OF ORAL DECISION DELIVERED BY a. sauve ON January 22, 2026 AND order OF THE TRIBUNAL
INTRODUCTION
1This was the first Case Management Conference (“CMC”) for this matter. The Appellant is seeking an Official Plan Amendment and Zoning By-law Amendment to facilitate development of two mixed-use residential buildings with 246 dwelling units, commercial space, and a three-storey amenity building. This is an appeal of a non-decision by the Town within the statutory time allowance.
2The Affidavit of Service of Marie Wakefield for today’s CMC was marked as Exhibit 1. The Parties submitted a draft Procedural Order and Issues List prior to this CMC.
3The Parties were made aware of the availability of Tribunal-led mediation.
4The Tribunal had also received a request for Party Status from an incorporated entity called Beamsville Bench Winery Association (“BBWA”) that is composed of several local wineries. The Appellant indicated that they objected to the Party status request of BBWA. The BBWA then requested to adjourn the Motion for Party Status as they needed time to prepare now knowing what the reasons for opposition to the request were. The Tribunal did not agree that more time was needed to prepare however the BBWA was unprepared to argue for Party Status at this CMC. Lead counsel for the BBWA was not in attendance.
5The Appellant and the Town had come prepared to the CMC with their Issues List completed and ready to set Hearing dates. It should be noted that the BBWA also submitted their own Issues List prior to this CMC. After discussion, the Tribunal decided that Merit Hearing dates would be set, and a written Motion for Party status would be brought in the meantime. Extra days would be scheduled for the Hearing in the event that BBWA is granted Party status. If not, the Parties will endeavour to inform the Tribunal that some days could be struck.
6The Tribunal had also received four Participant Status Requests. Matthew Barkovich, Scott Hatch, and Ryan Conlin were granted Participant status with no objection from either Party. However, the Participant Status Request of David Jacobs was denied as his residence is quite a distance from the proposed development and the site specific issues he wants to raise would not directly affect him.
NEXT STEPS
7A written Motion to determine the status of BBWA has been scheduled for Monday, February 9, 2026. The Motion materials are to be filed by Wednesday, January 28, 2026. A Response is to be filed by Wednesday, February 4, 2026, and the Reply, if any, is to be filed by Friday, February 6, 2026.
8A Procedural Order and Issues List is to be filed with the Tribunal within 3 days of the written Motion’s Decision or Order.
9A Merit Hearing has been scheduled for nine (9) days, to commence on Monday, October 5, 2026, at 10 a.m. by Video Hearing. The Tribunal will not be sitting on Monday, October 12, 2026, in observance of the Thanksgiving holiday.

THE TRIBUNAL ORDERS THAT:
A written Motion shall commence on Monday, February 9, 2026. Motion materials are to be filed with the Tribunal by Wednesday, January 28, 2026. A response is to be filed with the Tribunal by Wednesday, February 4, 2026. A Reply is to be filed with the Tribunal by Friday, February 6, 2026.
A Procedural Order and Issues List is to be filed with the Tribunal within 3 days of the Order/Decision of the written Motion Hearing.
A nine (9) day Merit Hearing shall commence on Monday, October 5, 2026, at 10 a.m. by Video Hearing. The Tribunal will not be sitting Monday, October 12, 2026, in observance of the Thanksgiving Holiday.
The Tribunal grants Participant Status to Matthew Barkovich, Scott Hatch, and Ryan Conlin.
