MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON JANUARY 21, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the second Case Management Conference (“CMC”) conducted in these proceedings before the Tribunal relating to an appeal brought by Power Play Equity Capital Inc. and Treasure Hill (“Appellant”) pursuant to s. 34(11) of the Planning Act (“Act”) from the refusal of the City of Cambridge (“City”) of a Zoning By-law Amendment (“ZBA”) relating to lands municipally known as 65 and 105 Ripplewood Road (“subject property”).
2The application was to facilitate the development of low- to medium-density residential uses on the subject property with a total of 752 dwelling units consisting of a mix of single-detached and townhouse dwellings.
3The corresponding application for a draft plan with the Regional Municipality of Waterloo (“Region”), now without upper tier review functions, has been appealed and received by the Tribunal (Tribunal file No. OLT-25-000752). For this draft plan appeal file, this is a first CMC.
4Counsel for the Appellant provided an update to the Tribunal and requested that the draft plan appeal be consolidated with the existing appeal. The Tribunal will consolidate these appeals as the Parties and subject property are the same. Parties requested a three-week hearing to be scheduled as the expert witnesses to be called would total around 10-12 witnesses.
STATUS REQUESTS
5Funchal Enterprises Inc. and Urros Investments Inc. (“Funchal & Urros”) requested Participant status to the consolidated proceedings. The Tribunal granted Participant status to Funchal & Urros without objections.
MEDIATION
6Counsel for the Appellant advised that Parties are still open to Tribunal-led mediation and would consider pursuing a mediation assessment following scoping of the Issues between the Parties.
HEARING
7The Tribunal will schedule a 15-day Hearing. There is no further Notice, and the Member is not seized.
8The Tribunal directs that the Procedural Order, with the deadlines filled in, together with the Issues List, be forwarded to the Case Coordinator by Tuesday, March 31, 2026.
9The Hearing is scheduled to proceed by video on Monday, November 23, 2026 at 10 a.m., continuing to Friday, December 11, 2026.

14THE TRIBUNAL ORDERS THAT:
Pursuant to rule 16.2 of the Tribunal’s Rules of Practice and Procedure, Tribunal file No. OLT-25-000752 be consolidated with Tribunal File No. OLT-24-000283;
Funchal Enterprises Inc. and Urros Investments are granted Participant status in the consolidated proceedings;
The Procedural Order and Issues List be filed by Tuesday, March 31, 2026; and
The 15-day Hearing is scheduled as set out above.
