MEMORANDUM OF ORAL DECISION DELIVERED BY STEVEN T. MASTORAS ON JANUARY 28, 2026, AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This matter is a first Case Management Conference ("CMC"), resulting from appeals under sections 22(7) and 34(11) of the Planning Act ("Act"), in the City of Vaughan, for the City's failure to adopt the requested Official Plan Amendment application ("OPA") and the refusal or neglect to make decision, regarding a Zoning By-law Amendment ("ZBA") application (together "Applications" / "Appeals").
2The Appeals were submitted by 2371933 Ontario Inc. ("Applicant" / "Appellant") for lands municipally known as 7520, 7540, and 7560 Weston Road ("Subject Lands"). The Applicant is proposing a development consisting of two (2) mixed-use residential buildings with proposed heights of 42 and 45 storeys respectively, supported by a four-storey podium with a total of approximately 952 residential units, and 734.88 square metres of ground-floor commercial space, all serviced by 824 parking spaces and 670 bicycle parking spaces. The proposed development has an FSI of 8.76 ("Proposal").
3Regarding the Notice of Hearing, two sworn Affidavits of Service, from Olena Kruk and Emily Clarkson, dated December 18, 2025, were noted by the Tribunal, and marked together as Exhibit 1, for the purposes of this CMC.
STATUS REQUESTS AND EXPECTED MOTION
4A single request for Participant status, was received from Gallu Construction Inc. ("Gallu") received on January 26, 2026, as represented by Daniel Artenosi and Justine Reyes. Gallu are the current owners of lands municipally known as 3899 and 3901 Highway 7 and 40 and 60 Winges Road (the "Gallu Lands").
5The Gallu Lands are within the surrounding area, with current applications for an Official Plan Amendment and a Zoning By-law Amendment, recently submitted as appeals with the City, on January 9, 2026, and expected to be received by the Tribunal in the immediate future ("Gallu Appeals"). There is no current file number established with the Tribunal, as of the date of this CMC.
6In addition to the request for Participant status, Counsel for Gallu requested that they be included in any future Tribunal-led mediation, if requested, related to the Appeals and are expected to be seeking the scheduling of a CMC that may allow this matter to be heard together with today's matter, and any other appeals, filed with the Tribunal. There were no objections noted from Counsel for each of the Parties related to this request and Participant status was conferred on Gallu.
7Counsel for the City confirmed for the Tribunal that a Notice of Motion, was filed on December 31, 2025 ("Motion"), and that the formal Motion materials are expected by the end of day, on January 28, 2026. The Motion will be requesting that today's matter (OLT-25-000733), and OLT-25-000892 (with a scheduled first CMC, on February 5, 2026) should be administratively consolidated, or heard together, with a separately scheduled Hearing matter (OLT-25-000288), at a future date, respectful of the Tribunal schedule.
8All of this is intended to deal with the commonality of issues that exist with the above three files, currently before the Tribunal, as they relate to the Weston 7 Secondary Plan ("W7SP") and, more specifically, the City's Transportation Master Plan ("TMP") in this area. Counsel for the City, also committed to serving the Motion materials to Gallu, in anticipation of formal confirmation from the Tribunal, that the Gallu Appeals have been received from the City and have been assigned the appropriate Case Numbers.
9Finally, of note for the benefit of the Tribunal, is that Counsel for the Applicants in this matter also act as solicitors for Canadian Tire Properties Inc. and Canadian Tire Real Estate Limited (collectively, "Canadian Tire"), the owner and tenant of the lands municipally known as 3850 Hwy 7, Woodbridge. Canadian Tire was previously conferred Party status to OLT-25-000288, as the adjacent property owners.
WESTON 7 SECONDARY PLAN
10For the benefit of the reader, the Tribunal confirmed that all the appeals referenced above fall within a Protected Major Transit Station Area ("PMTSA") and will likely have, among other issues, TMP-related matters for the consideration of the Tribunal in anticipation of a potential Phase 1 Hearing, subject to the Tribunal's determinations regarding the Motion.
11Importantly, all of the above matters of appeal fall within the recently adopted W7SP by the City, bounded by Fieldstone Drive, Chrislea Road, and Portage Parkway to the north; the Highway 400 corridor to the east; the Highway 407 corridor, Rowntree Dairy Road, and Trowers Road to the south; and Ansley Grove Road and Whitmore Road to the west.
12The W7SP was initiated in 2018 and was finally formally adopted by the City Council in October 2025, which forms part of Volume 2 of the also recently-adopted Vaughan Official Plan 2025 ("VOP 2025").
13The W7SP consists of a comprehensive planning framework to help guide development in the area, focused on ensuring that development in this distinct urban destination maintains a variety of commercial, cultural and entertainment amenities, and parks and open space, supported by housing, employment, and community facilities.
14Both the W7SP and VOP 2025 were submitted, as adopted by the City, before the Ministry of Municipal Affairs and Housing ("MMAH") on November 10, 2025, for consideration and approval and are presently in the public consultation and submissions process, ending February 1, 2026. While MMAH approval is pending, Parties present at this CMC shared their thoughts on how the various appeals already in the Tribunal system should be managed in the context of the W7SP and VOP 2025, as adopted.
NEXT STEPS
15The Parties are firstly reminded by the Tribunal that while there has been no scheduled mediation assessment planned to date, the availability of Tribunal-led mediation is something that could be carefully considered at the appropriate time on consent of the Parties.
16Following careful consideration of the circumstances involved, relating to each of the matters and with particular regard to the pending Motion referenced above to be heard on February 12, 2026, the Tribunal determined that for the purposes of the CMC matter before it today, the matter should be held in abeyance, pending the outcome of the Motion scheduled for February 12, 2026.
17The Tribunal also considered the Appellant request for a further CMC, shortly after the Motion date of February 12, 2026, in an effort to help guide the progress of its Appeals before the Tribunal, fully aware that it may not, in fact, be necessary, subject to the Tribunal's Motion directions. The Tribunal agreed and directed that a further CMC be set down to commence on Wednesday, February 18, 2026, commencing at 10 a.m. by video conference.

ORDER
24THE TRIBUNAL ORDERS THAT:
A Decision to schedule a Hearing of the Merits, in the matter of appeals from 2371933 Ontario Inc., is hereby held in abeyance until a Tribunal Decision is made regarding a Motion for Direction on February 12, 2026;
The date and particulars of a further Case Management Conference, as noted above in paragraphs [17] and [18], is hereby ordered; and,
All other directions in this Decision are so ordered.
25The Member is not seized on this matter, however, is available to assist if anything is required from the Parties.
