Decision
THIS MATTER, is a proposed Urban Service Line amendment which would extend the boundaries of the urban service area of Sault Ste. Marie, by The Corporation of the City of Sault Ste. Marie (City). The City is requesting an Order to alter the boundaries of the existing Urban Service Line, By-Law 2025-75 (Application) pursuant Section 370.1 (1) of the Municipal Act.
AND THE TRIBUNAL, having received and considered and marked the following Exhibits:
- Affidavit of Service, sworn on November 12, 2025 by City Clerk, Rachel Tyczinski;
- Jeffery King Solicitor of the City, letter dated July 23, 2025;
- City Engineering Department Letter dated July 22, 2025; and
- PUC Services Inc. letter dated June 24, 2025.
THE TRIBUNAL having been advised by Rachel Tyczinski, City Clerk, by Affidavit of Service sworn on November 13, 2025, that a proper notice of application had been given, as directed by the Board, and no objections having been filed;
THE TRIBUNAL having been advised by Jeffrey King City Solicitor, that the Council of the City at its meeting on April 28, 2025, passed By-law 2025-74, which is enclosed herein Attachment 1. This by-law proposes to amend the Urban Service Line for municipal water and sewer services in the area shown on Schedule "A" to the by-law.
THE TRIBUNAL having accepted Jeffrey King’s submission in support of the City’s Urban Service Line amendment, including a letter dated July 22, 2025, from the City’s Engineering Department confirming the sanitary sewer is adequate to accommodate future development and a letter dated June 24, 2025, from PUC Services Inc. confirming that the existing water can accommodate the extension of water service;
NOW THEREFORE:
THE TRIBUNAL ORDERS that the application by the City for approval of its By-law 2025-74, passed on April 28, 2025, pursuant to Section 370.1 (1) of the Municipal Act, being a by-law to amend the Urban Service Line, as described in Attachment “1” attached hereto, is hereby approved.
