ORDER
UPON AN APPEAL having been brought by South Hill (Ancaster) Inc. (“Appellant”) under subsection 44(12) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, against the City of Hamilton (“City”) in respect of its Site Plan Application (“SPA”) seeking to facilitate the development of 59 townhouse units in ten blocks on a private condominium road at the lands municipally known as 509 Southcote Road;
AND THIS MATTER having originally been scheduled by notice from the Tribunal dated January 2, 2026 for its first event as a one-day Hearing to be heard on Monday, June 8, 2026, by videoconference;
AND THIS MATTER having been converted to a Case Management Conference (“CMC”) by notice from the Tribunal dated June 2, 2026, on account of being advised that the Parties had arrived at a settlement-in-principle;
AND THIS MATTER having come before the Tribunal on Monday, June 8, 2026, by videoconference for the CMC in order to deal with certain procedural matters including the identification of Party and Participants as well as the scheduling of a Hearing to consider the proposed settlement;
AND THE TRIBUNAL having received no requests for either Party or Participant status, the Parties having confirmed same;
AND THE TRIBUNAL having been advised that the Appellant had recently received from the City its revised draft SPA conditions which the Appellant was in the process of reviewing, and which appeared to implement the settlement-in-principle;
AND THE TRIBUNAL having been further advised that that the settlement-in-principle requires the issuance of an amended approval notice from the City, subsequent to which the Parties would only then be in a position to file written hearing materials in relation to the settlement reached and were not yet in a position to determine a reasonable deadline for the filing of those materials;
AND THE TRIBUNAL having considered the submissions of the Parties, directed that the Hearing to consider the proposed settlement be conducted in writing, and that it be adjourned sine die;
AND THE TRIBUNAL having further directed that, should the Parties not be in a position to file written hearing materials on or before 5 p.m. on Tuesday, June 30, 2026, that Counsel for the Appellant shall provide the Tribunal with a status update on or before that date with an explanation for the delay and the anticipated timeline for the filing of the written hearing materials;
NOW THEREFORE THE TRIBUNAL ORDERS THAT:
The Hearing to consider the Parties’ proposed settlement shall be conducted in writing and is adjourned sine die.
Should the Parties be unable to file written hearing materials on or before 5 p.m. on Tuesday, June 30, 2026, Counsel for the Appellant shall provide the Tribunal with a status update on or before that date with an explanation for the delay and the anticipated timeline for the filing of the written hearing materials.
This Member is not seized.
