UPON APPEAL having been brought pursuant to section 34(11) of the Planning Act (“Act”) by Midtown-Yonge Properties Inc. (“Applicant”) resulting from the refusal by the Council of the City of Toronto (“City”) of an application for a Zoning By-law Amendment, required to facilitate a mixed-used development on lands known municipally as 1-13 St. Clair Avenue West in the City (“Subject Property”);
AND THE TRIBUNAL at the second Case Management Conference (“CMC”) held on May 28, 2026 having received a draft Procedural Order and having directed the Parties to submit a final Procedural Order and Issues list for the Tribunal’s Approval by Friday, June 12, 2026;
AND THE TRIBUNAL, having considered the Parties’ request for a hearing, has scheduled fifteen (15) days for the hearing (“Hearing”) commencing Monday, April 12, 2027 until Friday, April 30, 2027:

AND THE TRIBUNAL having advised the Parties to consider engaging in mediation in an attempt to settle some of the issues or the matter in its entirety;

THE TRIBUNAL ORDERS THAT:
the Hearing is scheduled as described above;
the final Procedural Order for the Tribunal’s consideration and approval is to be submitted by Counsel for the Applicant by Friday, June 12, 2026;
this Member shall remain seized of any matters or questions arising from this Order that might arise prior to the Hearing.
