THIS IS A MATTER of the appeals filed by 2034055 Ontario Limited under subsection 34(11) of the Planning Act, R.S.O. 1990, c. P.13, as amended and in respect of the lands known municipally as 65 Ookwemin Street (formerly 309 Cherry Street) in the City of Toronto;
AND WHEREAS THE TRIBUNAL issued its interim Decision and Order on March 26, 2026 and subsequently issued a corrected version of the Decision on March 30, 2026;
AND WHEREAS the Toronto Port Authority and NAV Canada filed requests for review (“Requests”), pursuant to s. 23 of the Ontario Land Tribunal Act, 2021 and Rule 25 of the Tribunal’s Rules of Practice and Procedure (“Rules”), which seek to review the Decision;
AND WHEREAS THE CHAIR thereafter decided to exercise his discretion under Rule 25.12 to initiate a request for review (“Request”) for reasons given in his letter of disposition, dated June 4, 2026;
AND WHEREAS THE CHAIR further decided to exercise his discretion under Rule 25.6(b) to order a one-day motion for review to be heard electronically before the Tribunal to consider the Request;
ACCORDINGLY, THE TRIBUNAL HEREBY ORDERS that:
A one-day motion for review to be heard electronically pursuant to Rule 25.9 will be scheduled before a different Member of the Tribunal in accordance with the Chair’s letter of disposition dated June 4, 2026.
The Member assigned to conduct the motion for review is hereby delegated the Chair’s authority to consider and dispose of the Request in accordance with Rule 25.9 and the Chair’s letter of disposition dated June 4, 2026.
All of which are ordered pursuant to my authority under section 23 of the Ontario Land Tribunal Act, 2021 and Rule 25 of the Tribunal’s Rules of Practice and Procedure.
