INTRODUCTION
1This proceeding was commenced by the Claimants arising from the expropriation of lands by the City located at 1380 Oxford Street East in the City on November 9, 2024. The proceeding seeks compensation in accordance with section 26 of the Expropriations Act, R.S.O. 1990, c. E.26.
2There are no other Parties to this proceeding and the issues are captured in the Notice of Arbitration and Statement of Claim filed by the Claimant and in the Reply delivered by the City.
3On May 15, 2026 a status conference was held by video. This proceeding is currently scheduled for a final hearing commencing June 16, 2026. However, there is no Procedural Order (“PO”) in place and the preparations for the hearing are apparently incomplete notwithstanding that it is only one month away.
4The Parties’ counsel acknowledge that examinations for discovery have only recently been completed in late April 2026 and that there appear to be some outstanding matters of informational and documentary disclosure. Nonetheless, the Claimant’s counsel insists on maintaining the current hearing dates while the City’s counsel still has some doubts as to whether the Parties will be ready in time.
5At the urging of the Tribunal, the Parties also had some discussion concerning the timelines for certain pre-hearing events and have proposed certain deadlines which are captured in the Orders made below. This is in lieu of the usual practice of the issuance of a PO at an early date in an expropriation proceeding.
6The Tribunal has also added two days to the currently scheduled hearing, being Friday, June 19 and Monday, June 22, 2026 because it believes that 3 days will not be adequate.
ORDER
7THE TRIBUNAL ORDERS THAT:
(a) This matter has been scheduled for a hearing as described above to which two additional days have been added;
(b) The following timelines prior to the hearing shall be followed by the Parties:
(i) Exchange of Witness or Expert Witness Statements or Reports on or before May 25, 2026
(ii) Any written motions arising from undertakings on or before May 29, 2026
(iii) Expert Witnesses of the same field shall meet on or before May 29, 2026
(iv) Filing of Joint Statement of Agreed Facts and Issues on or before June 1, 2026
(v) Exchange of Reply Witness Statements on or before June 5, 2026
(vi) Any written motions seeking to limit or exclude written or oral evidence of any witness on or before June 8, 2026
(vii) Submissions of Joint Document Book on or before June 8, 2026, bookmarked in PDF format with hyperlinks to all items listed in any table of contents
(viii) Submission of Joint Compendium of Witness Statements on or before June 8, 2026 bookmarked in PDF format with hyperlinks to all items listed in any table of contents
(ix) Preliminary Hearing Plan on or before June 12, 2026
(c) This Vice-Chair shall remain seized of this proceeding for ongoing case management purposes, including all motion practice, and for the final hearing but shall not be seized for any mediation which may be convened.
