MEMORANDUM OF ORAL DECISION DELIVERED BY W. DANIEL BEST ON MaY 20, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1On consent of the Parties, the Tribunal scheduled a Telephone Conference Call for an update on the Interim Order issued on April 29, 2025, under Tribunal Case No. OLT-24-000004 ("April Decision"). The April Decision approved a settlement between the Parties on the Official Plan Amendment ("OPA") and Zoning By-law Amendment ("ZBA") appeals for the development of two 12-storey apartment buildings on lands known municipally as 1242-1270 Gordon Street and 9 Valley Road ("Subject Lands").
2The Site Plan appeal ("SPA") for the Subject Lands was filed pursuant to s. 41(12) of the Planning Act, R.S.O. 1990, c. P.13, as amended ("Act") and assigned Tribunal Case No. OLT-24-000788. The SPA was heard together with the OPA and ZBA appeals and subject to the Interim Order under the April Decision.
3The Interim Order allowed the appeal, in part and the site plan prepared by Stantec Consulting Ltd., dated February 19, 2025, and set out in Attachment 1 to this Decision was approved, in principle, on an interim basis and final approval was withheld subject to counsel of the Appellant advising in writing that:
- The plans and drawings are in a final form that is satisfactory to the Parties;
- Conditions of site plan approval have been agreed upon amongst the Parties; and
- The finalised plans, drawings, and conditions of site plan approval have been submitted to the Tribunal for consideration
4Counsel for the Parties advised that they have been scoping the conditions of site plan approval ("Conditions").
5Mr. Baker, Counsel for the Applicant presented an overview and advised that the City is in possession of responses to the outstanding Conditions.
6Mr. Gross, Counsel for the City advised that a review of the Applicant's responses to the Conditions is scheduled for May 25, 2026, with an anticipated reply to the Applicant by May 27, 2026.
7At this time, the Parties do not believe that all of the Conditions will be resolved after the City's review.
NEXT STEPS
8The Tribunal directed the Applicant and the City to report back to the Case Coordinator, in writing by Monday, June 1, 2026 to provide a suggested path forward on this matter for the consideration of the Tribunal.
