UPON APPEALS having been brought pursuant to section 17(36) of the Planning Act by numerous Appellants, as listed at Attachment 1 to this Decision, resulting from the approval by the Town of Niagara-on-the-Lake ("Town") of Official Plan Amendment 99, namely the Glendale Secondary Plan, which was approved by the Town on January 28, 2025;
AND THIS MATTER having come before the Tribunal for a first Case Management Conference ("CMC") on June 6, 2025, wherein it was confirmed that adequate Notice was served and no further Notice was required; White Oaks Tennis World Inc. and 1526882 Ontario Inc. was added as a non-Appellant Party; and a second CMC was scheduled, which took place on January 19, 2026;
AND THE TRIBUNAL, having received a request for Party status from Julie Smith and, upon reviewing her statement and materials in support of the status request, and hearing submission from the Town that Ms. Smith's status request did not meet the requirements of being a Party in this proceeding, determined that Ms. Smith should more appropriately take part in this proceeding as a Participant, as her request did not meet the test outlined in Rule 8.2 of the Tribunal's Rules of Practice and Procedure for being a Party, but that the concerns she had raised would be reviewed and considered by the Tribunal within the bounds of her role as a Participant;
AND THE TRIBUNAL having confirmed the Parties' awareness of Tribunal-led mediation;
AND THE TRIBUNAL being advised by the Parties that the Town had reached a settlement agreement with two of the Appellants and was near reaching a settlement agreement with the remaining Appellants, scheduled a hearing for Friday, March 6, 2026 at 10 a.m., by video conference, to consider these settlement agreements or, in the alternative, to be a third CMC to address procedural matters with respect to any Appeals that remain unresolved, with the following log-in-credentials:

a. Materials in support of the settlement agreements are to be provided to all Parties and filed with the Tribunal by Monday, February 23, 2026;
b. Any responding materials to the settlement materials are to be provided by Tuesday, March 3, 2026; and
c. If any Appeals remain unresolved, a Procedural Order and Issues List, or a status update, is to be provided to the Tribunal by Tuesday, March 3, 2026.
