THESE MATTERS in respect of the lands at 129, 133, 135, 137, 139 and 141 Vaughan Road in the City of Toronto, having come before the Ontario Land Tribunal (the “Tribunal”) for a hearing on October 27, 2022, and the Tribunal having heard expert opinion evidence from David Morse, MCIP, RPP, and having heard submissions of counsel for the parties;
AND THE TRIBUNAL having issued a decision on March 10, 2023, ordering that the Site Plan attached as Schedule B to its decision was approved in principle, with the final order withheld pending confirmation from the City Solicitor that the Conditions of Site Plan Approval contained in the to-be-issued Notice of Approval Conditions had been satisfied;
AND THE TRIBUNAL having been advised that the Conditions of Site Plan Approval have been cleared to the satisfaction of the City of Toronto and the Site Plan agreement has been signed and executed;
NOW THEREFORE
THE TRIBUNAL ORDERS that the Site Plan Control appeal is allowed in part, and the Site Plan attached as Attachment 1 to this Order is hereby approved, subject to the Site Plan Agreement, set out in Attachment 2 to this Order;
AND THE TRIBUNAL FURTHER ORDERS that it may be spoke to in the event some matter should arise in connection with the implementation of this Order.
