MEMORANDUM OF ORAL DECISION DELIVERED BY S. deBOER ON APRIL 28, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This Decision arises from the first Case Management Conference (“CMC”) for the appeal by 2915-2943 Bloor Street West Developments Limited (“Appellant”) pursuant to s. 34(11) of the Planning Act due to the City of Toronto’s (“City”) failure to make a decision on the application within the statutory timeline. The Zoning By-law Amendment (“ZBA”) application would permit the redevelopment of the lands known as 2915 Bloor Street West, in the City of Toronto (“Subject Lands”), with a 29-storey mixed-use residential building containing 423 dwelling units.
2The purpose of the CMC was to review any Party and Participant status requests and set a date for the next hearing event.
AFFIDAVIT OF SERVICE
3The Tribunal reviewed the Affidavit of Service of Notice with the Parties, which was served on April 10, 2026, by Rochelle Vasquez. As the Tribunal found no issues with the Notice, the Tribunal ruled that no further Notice is required and marked the Affidavit of Service as Exhibit 1 to this CMC.
PARTY REQUEST
4The Tribunal received one Party status request prior to the CMC from Michael Varghese. Prior to the CMC, the Tribunal had sent the role and responsibilities of a Party to Mr. Varghese. The Tribunal questioned the Party Status request made by Mr. Varghese and after this discussion, Mr. Varghese requested to change his status request from a Party to a Participant.
PARTICIPANT REQUESTS
5Prior to the CMC, the Tribunal had received a total of 43 Participant status requests. After reviewing with the Parties, the Tribunal ruled that the Participant requests received prior to this CMC would be accepted by the Tribunal. The list of approved Participants is attached as Addendum 1 to this Decision and includes the Party status change of Mr. Varghese, approved by the Tribunal at this CMC, for a total of 44 approved Participants. These Participant Statements and their concerns will be reflected in the final decision of the appeal before the Tribunal.
6The Tribunal noted during the CMC that additional individuals had sent emails of concern about the appeal. The Tribunal directed these individuals to send a request for Participant Status form and status request if they wanted to have their concerns formally reviewed by the Tribunal. If additional Participant Status requests are received and reviewed by the Tribunal, they may be added to Addendum 1 at the next hearing event.
7The Tribunal further directs the City to work with the Participant Statements and provide a list of common issues and themes of issues and submit them to the Tribunal prior to the next CMC event. A summary of Participant issues will streamline their concerns for the Parties to address in evidence.
OPPORTUNITIES FOR RESOLUTION
8The Tribunal asked the Parties about opportunities for resolution, including Tribunal-led mediation. The Parties stated that since an Issues List has not been completed, it is too early to request mediation. However, once an Issues List has been completed, the Parties confirmed that mediation will be discussed, and the Parties are directed to inform the Tribunal if mediation will be requested.
PROCEDURAL ORDER AND ISSUES LIST
9The City stated that it is currently waiting for direction from its Council concerning the appeal, and this direction will not be given until the Council meeting of May 20, 2026. The Parties stated that once this direction is received, it is the intent of the Parties to have a completed Procedural Order and Issues List to the Tribunal prior to the next CMC. The Parties requested that a second CMC be scheduled for a date within June 2026. This would allow the Parties enough time to complete the Procedural Order and Issues List and submit it to the Tribunal. Based on this request, the Tribunal has scheduled a second CMC set out below. The Tribunal directed the Parties to submit a finalized Procedural Order and Issues List by Friday, June 19, 2026, for the Tribunal’s review.
SECOND CASE MANAGEMENT CONFERENCE
10The Tribunal has scheduled a second CMC to proceed on Tuesday, June 23, 2026, at 10 a.m., by video conference. No further Notice will be issued.

15As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
