UPON APPEALS having been brought pursuant to section 17(36) of the Planning Act by numerous Appellants, listed at Attachment 1 to this Order, arising from the approval by the County of Simcoe on September 24, 2024 of the new Official Plan (“OP”) for the Town of Collingwood, which the Town adopted on December 11, 2023;
UPON A HEARING having been scheduled to proceed from May 6 to 29, 2026, but having been adjourned as it was to address general Appeals of the OP, but all Appeals have since been scoped to be site-specific, and those Hearing dates no longer being required;
AND THE TRIBUNAL, conducting this Status Hearing Telephone Conference Call (“TCC”) to address procedural issues arising from the adjournment of the Hearing and regarding the numerous outstanding Appeals;
AND THE TRIBUNAL, determining that a further Case Management Conference (“CMC”) would be beneficial to allow for a fulsome review of the Appeals to be addressed and of a draft Procedural Order (“PO”) and Issues List (“IL”) to be prepared by the Parties and presented to the Tribunal, and scheduling a further CMC to take place on Tuesday, June 30, 2026, with details contained below;
AND THE TRIBUNAL, providing directions on the preparation of the Procedural Order and Issues List as follows:
The Parties are to contemplate whether (and how) some or all of appeals can be grouped together and addressed at the same Hearing or if a number of Hearings are required to address each site-specific appeal;
The Parties are to contemplate whether it is necessary for the same Adjudicator to address all Appeals and / or the decisions can be separate and distinct from each other;
The Parties are to contemplate the timelines for various Appeals and potential Hearing dates; and
The Parties are to provide a draft PO and IL, or a status update, to the Tribunal’s Case Coordinator by Tuesday, June 23, 2026. The City’s Counsel undertook to provide this.
AND THE TRIBUNAL, being advised by the City’s Counsel that a Motion to bring the unappealed portions of the OP into force and effect is to be brought by the City, hearing no objections or concerns from the other Parties, and ordering that the Motion be brought on the same day as the next CMC, with the Parties serving motion materials in accordance with the timelines indicated in the Tribunal’s Rules of Practice and Procedure;
AND THE TRIBUNAL, at the TCC, having scheduled a further CMC and the Motion to take place on Tuesday, June 30, 2026, at 10 a.m., by video conference, with the following details:

AND THE TRIBUNAL noting that, as of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
NOW THEREFORE,
THE TRIBUNAL ORDERS THAT:
The Procedural Order and Issues List, or a status update, are to be provided to the Tribunal by Tuesday, June 23, 2026.
The next Case Management Conference is scheduled as detailed above.
The Motion to consider the unappealed portions of the Official Plan is scheduled as detailed above.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”).
