## MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON MAY 12, 2026 AND ORDER OF THE TRIBUNAL
### PRELIMINARY MATTER
[1] At the onset of this Case Management Conference (“CMC”), the Tribunal was informed that the Notice of the CMC contained a wrong log-in link for GoToMeeting. With input from the Parties, the Tribunal ruled that this CMC will proceed, subject to a correct Notice being sent for a necessary second CMC, to ensure that all persons who wish to observe or participate are duly notified.
### INTRODUCTION
[2] This was the first CMC in the matter of the appeals by Park Hill Inc. (“Appellant”), arising from the failure of the City of Toronto to make a decision within the applicable statutory timeline for an Official Plan Amendment and Zoning By-law Amendment, pursuant to ss. 22(7) and 34(11) of the Planning Act, for the property located at 5-15 Park Hill Road (“subject property”).
[3] The Appellant is seeking to permit the development of a 48-storey residential building with 505 dwelling units.
[4] The Tribunal marked the Affidavit of Service as Exhibit 1.
### PARTY STATUS REQUEST
[5] In advance of the CMC, the Tribunal received one Party Status request from Park Hill Road Neighbourhood Association (“PHRNA”).
[6] PHRNA is concerned with respect to land use, built form, transition, neighbourhood character, traffic and access, construction impacts, shadowing, privacy, and related planning matters.
[7] The Tribunal granted Party Status request to PHRNA.
### PARTICIPANT STATUS REQUESTS
[8] Prior to the CMC, the Tribunal received four Participant Status requests from Hugh Pattison, Jeff Small, Roseanne Lidstone and Starbank Developments 1416 Corp.
[9] Residents’ concerns are related to overdevelopment, height, lack of transition, parking, traffic, emergency access, wind, microclimate and lack of green space.
[10] Starbank Developments 1416 Corp. (“Starbank”) is the owner of lands in the immediate vicinity of the subject property and has a vested interest in the outcome of the appeal. Starbank did not outline their concerns in the Participant Statement. The Tribunal directed Starbank to update its Participant Statement by Thursday, May 14, 2026.
[11] Although the Tribunal’s Rules of Practice and Procedure do not contain a set date for filing a Participant Statement, the Tribunal finds that it is beneficial to the statutory Parties to have a Participant Statement prior to compiling of the Issues List, in order to plan if any additional expert witnesses should be present at the Hearing to address Participants’ concerns.
[12] The Tribunal granted Participant Status request to:
- Hugh Pattison;
- Jeff Small;
- Roseanne Lidstone; and
- Starbank Developments 1416 Corp.
### MEDIATION
[13] The Tribunal reminded the Parties that if they are interested in Tribunal-led mediation, they should reach out to the assigned Case Coordinator.
### CMC, PROCEDURAL ORDER AND ISSUES LIST
[14] The Parties requested to schedule a second CMC after a City Council meeting is held.
[15] A draft Procedural Order and Issues List are due on or before Wednesday, July 22, 2026.
[16] A second CMC is scheduled to proceed by video on Wednesday, August 5, 2026 at 10 a.m.

This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
