INTRODUCTION
1This Decision and Order arises from a second Case Management Conference (“CMC”) held in respect of an appeal filed by Lucas Schilder pursuant to s. 34(19) of the Planning Act (“Act”) against the approval by the Township of North Huron (“Township”) of Township-initiated Zoning By-law No. 71-2023, being an amendment to the Township’s comprehensive Zoning By-law in order to implement the Township’s updated Official Plan.
2The appeal was scoped at the first CMC to the following properties: 84630 and 85043 Marnoch Line; 83925 Currie Line; 85190 and 85270 Beecroft Line; and 38934, 39705, 39725, and 39791 Belgrave Road (“Properties”).
REQUESTS FOR STATUS
3There were no requests for Party or Participant status ahead of or during the CMC.
UPDATE
4Mr. Schilder advised that he was no longer represented by Mr. Jonathan Minnes, was currently seeking to retain new legal counsel, and had recently engaged a land use planner.
5Mr. Stewart indicated that there was potential to resolve the appeal with respect to most of the Properties, but additional time would be needed to obtain instructions from Township Council in that regard. The Parties expected that the appeal could be further scoped to 39725 and 39791 Belgrave Road.
NEXT STEPS
6The Tribunal was in receipt of a draft Procedural Order (“PO”) that noted a one‑day merit hearing but did not include an Issues List (“IL”). Following discussions between the Parties, it was agreed that a third CMC is necessary to finalize the scope of the appeal and the draft PO and IL, and that scheduling a merit hearing date would be premature at this time.
7Mr. Schilder undertook to finalize the IL, and the Parties agreed to submit the finalized draft PO, including the IL, to the Tribunal by Friday, July 31, 2026. The Parties further undertook to advise the Case Coordinator by Friday, July 24, 2026, if further time is required for the submission of the draft PO.
HEARING EVENT
8The Tribunal scheduled a third CMC to proceed by video hearing on Tuesday, August 4, 2026, at 10 a.m.

13As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
MEDIATION / SETTLEMENT
14The Tribunal advised the Parties of the options for Tribunal-led mediation, or for a written hearing in the case of a settlement, and to contact the Case Coordinator to determine next steps if the need arises.
ORDER
15THE TRIBUNAL ORDERS THAT:
The final draft Procedural Order and Issues List is to be filed with the Tribunal as directed above;
An update to the Case Coordinator is required ahead of the third Case Management Conference as directed above; and
The third Case Management Conference will be proceed as scheduled above.
16No further notice is required.
17The Member is not seized of this matter.
