1The Tribunal held a Case Management Conference (“CMC”) on May 13, 2026, regarding the appeal filed by S.G. Canada Inc. (“Appellant”) under s. 91(2) of the Resource Recovery and Circular Economy Act regarding the Decision and Order of the Deputy Registrar of the Resource Productivity and Recovery Authority (“RPRA”) against the Appellant, dated February 10, 2026 (“Order”).
2At the CMC, the Parties stated that the Appellant is working to comply with the Order and is in the final stages of retaining a Producer Responsibility Organization (“PRO”) to assist in carrying out the Appellant's responsibilities. The Parties requested that the Tribunal schedule a further CMC for a date in June 2026 to allow the Appellant time to finalize its retainer with the PRO and comply with the Order. The Tribunal agreed to this proposal and urged the Appellant to retain a PRO on an urgent basis, ideally within the next week.
3The Tribunal directed that a further CMC will be held by video hearing commencing on Wednesday, June 17, 2026, at 10 a.m.

8As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
9The Tribunal requested that the Parties inform the Tribunal forthwith if a settlement or withdrawal of the appeal comes to pass and the next CMC is no longer necessary.
