MEMORANDUM OF ORAL DECISION DELIVERED BY STEVEN T. MASTORAS ON MAY 6, 2026, AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This matter is a first Case Management Conference ("CMC") resulting from an appeal under section 17(36) of the Planning Act ("Act") ("Appeal"), relating to the Town-initiated Franktown Road Neighbourhood Secondary Plan ("FRNSP"), and adopted by the Town on October 7, 2025. The County approved the FRNSP on December 10, 2025, as Official Plan Amendment No. 11 ("OPA 11"). Of note, funding for this study was provided through a Housing Accelerator Fund grant, under the Canada Mortgage and Housing Corporation.
2OPA 11 is intended to guide a number of priorities related to future growth, some of which includes land use, development densities, transportation, and servicing requirements within the FRNSP area.
3The FRNSP area is configured as a U-shape, occupying approximately 25 hectares, north of Highway 7, east of Franktown Road, and west of McNeely Avenue. There are approximately 17 separately-owned parcels of land that are presently without municipal services, however, are adjacent to an existing residential development that is fully-serviced to the north.
4The Appellant is the owner of the lands municipally known as Block 29, Plan 27M-106 that were initially excluded from OPA 11, which constitutes the above-referenced U-shape configuration ("Coleman Phase 2 Lands").
5The Coleman Phase 2 Lands are the subject of a recently-approved Draft Plan of Subdivision, registered in July 2025. The Appellant appeared and corresponded with the Town and County, in opposition to the exclusion. Furthermore, prior to its adoption, revisions to OPA 11 included the delineation of a proposed new Collector Road alignment that the Appellant argues is not appropriate for a number of reasons.

7STATUS REQUESTS
8A single written request for Participant status was submitted by Steven Waddell, dated April 19, 2026, as the owner of 285 Franktown Road, sharing input from his experience in the public consultation process, asserting that OPA 11:
Appears to adequately contend with development already underway; and
Shows regard for concerns such as traffic flow and municipal servicing constraints.
9There were no objections to this request, and the Tribunal conferred Participant status on Steven Waddell.
NEXT STEPS
10The Parties are firstly reminded by the Tribunal that, while there has been no scheduled mediation assessment planned to date, the availability of Tribunal-led mediation is something that should be carefully considered at the appropriate time on consent of the Parties.
11Noting that the Parties have been considering a draft Procedural Order ("PO") over several weeks, and that further input from the Town Council may be required regarding a draft Issues List ("IL"), the Tribunal determined that a further CMC should be scheduled.
12The further CMC is scheduled to proceed by video on Wednesday, July 15, 2026, at 10 a.m.

18The Tribunal further directed that a draft PO/IL be submitted to the Tribunal for its consideration on or before Wednesday, July 8, 2026.

19THE TRIBUNAL ORDERS THAT:
The date and particulars of the scheduled further Case Management Conference, as noted above, are hereby ordered; and
All other directions in this Decision are so ordered.
20The Member is not seized on this matter, however, is available to assist if anything is required from the Parties.
