MEMORANDUM OF ORAL DECISION DELIVERED BY D. CHIPMAN ON MAY 6, 2026, AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This was the first Case Management Conference (“CMC”) held for the purpose of organizing the appeal by Russell Pines Property Corp. (“Appellant”) against the failure of the Town of Halton Hills (“Town”) to make a decision on an application for a Zoning By-law Amendment (“ZBA”) and draft Plan of Subdivision (“PoS”) pursuant to ss. 34(11) and 51(34) of the Planning Act (“Act”), in relation to the property located at 16469 10 Side Road (“Subject Property”).
2The proposed development includes 274 single-detached dwellings, 470 townhouse dwellings, a mixed-use block, two neighbourhood parks, one parkette, and a stormwater management pond.
3The Tribunal received the sworn Affidavit of Christopher Drew, dated April 21, 2026, confirming that Notice of the CMC was properly given, and as such, no further Notice is necessary.
4The Tribunal advised the Parties that a written submission, without the required Status Request form, was received by the Case Coordinator during the CMC. The Tribunal advised the Parties that the submission would be circulated promptly and that the Case Coordinator would follow up with the authors to confirm whether Party or Participant status was being sought. The Case Coordinator will subsequently update the Parties.
5The Tribunal was provided with a draft Procedural Order (“PO”) and Issues List (“IL”), with both Parties noting that the IL requires further refinement. At the Town’s request, and with the Appellant’s agreement, the list will be refined for greater specificity.
MEDIATION
6The Tribunal noted that information on Tribunal-led mediation is available through the Case Coordinator and encouraged the Parties to consider this option to help resolve some or all issues identified. Counsel for the Town indicated he will seek Town Council’s direction on obtaining Tribunal-led mediation at the May 11, 2026 meeting and advise the Tribunal and Appellant accordingly.
SECOND CASE MANAGEMENT CONFERENCE
7The Parties requested a second CMC to allow time to scope, or resolve, some, or all, the issues. The Tribunal scheduled a second CMC for Tuesday, November 17, 2026. The Tribunal directed the Parties to submit, on consent, a finalized PO and IL for the Tribunal’s review and approval no later than Monday, November 2, 2026. If a settlement is reached, they may email the assigned Case Coordinator to request conversion of the CMC to a settlement hearing for the Tribunal to consider same.
FUTURE HEARING
8The Parties requested 15 days be set aside for a hearing on the merits in January 2027, based on the number and disciplines of witnesses anticipated to be called. On consideration of the foregoing, the Tribunal scheduled a 14-day hearing for Monday, January 11, 2027 to Friday, January 29, 2027. The Tribunal will not sit on Monday, January 25, 2027.
9The second CMC and future hearing are scheduled to proceed by video as follows:
