INTRODUCTION
1This Decision relates to a Merit Hearing (“Hearing”) regarding appeals filed by Raglan Development Corp. c/o The Goldman Group (“Applicant/Appellant”) pursuant to s. 114(15) of the City of Toronto Act and s. 45(12) of the Planning Act (“Act”) regarding applications for site plan approval and minor variances made to the City of Toronto (“City”) for the property municipally known as 5, 7, 9, 11, 13 and 15 Raglan Avenue (“Subject Site”).
2The Tribunal was advised prior to the Hearing that the Parties would be requesting an adjournment of the site plan appeal to allow the Applicant/Appellant and the City time to finalize the Notice of Approval Conditions (“NOAC”). The Tribunal was also advised that the City would not be opposing the minor variance appeal but was requesting the imposition of conditions that were recommended by City Planning Staff and to which the Applicant/Appellant was agreeable.
BACKGROUND
3In November 2021, the Applicant/Appellant submitted an application to amend the City of Toronto Zoning By-law 569-2013, the former City of Toronto Zoning By-law 438-86, and the former City of York Zoning By-law 1-83 to permit the development of a 24-storey residential apartment building (“ZBA Application). It, and a related site plan application, was appealed in 2022 as Council had failed to make a decision on the ZBA Application within the required timeframe.
4Through discussion and eventual mediation, a revised set of architectural plans was agreed to through a settlement. The revised plans were for a 28-storey building with 210 residential units and 16 square metres of commercial retail space along Raglan Avenue, which were approved by Council and subsequently conditionally approved by the OLT
