MEMORANDUM OF ORAL DECISION DELIVERED ON April 28, 2026 BY J. CAMPBELL AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This Decision arises from a settlement hearing (“Hearing”) before the Ontario Land Tribunal (“Tribunal”) regarding an appeal by 840966 Ontario Ltd. ( “Appellant”) of By-law 2024-095 (the “By-law”) concerning the designation by the City of Caledon (“City”) of the property located at 18906 Main Street in Caledon, Ontario (“Subject Property”) as being of cultural heritage value or interest under Section (“s.”) 29, Part IV of the Ontario Heritage Act, R.S.O. 1990, c. O.18 (“Heritage Act”).
BACKGROUND
2The Appellant is the registered owner of the Subject Property, which comprises an irregularly shaped 197-acre parcel of land located on the west side of Main Street in the City. The Subject Property contains a gatehouse at the road edge and a farm complex set back on a rise from Main Street.
3On August 1, 2024, the City issued a notice of intent to designate the Property under s.29 of the Heritage Act. On November 26, 2024, the City passed the By-law, which designated the Property under s.29 of the Heritage Act as being of cultural heritage value and interest.
4The Appellant appealed the By-law to the Tribunal on December 30, 2024, and a hearing that was originally scheduled by the Tribunal was adjourned on consent to permit without prejudice resolution discussions between the Parties.
SETTLEMENT DISCUSSIONS
5At the Hearing, the Parties advised the Tribunal that they had reached a settlement in respect of the matters under appeal; however, they did not yet have signed minutes of settlement in hand. Given the preference for having conclusive and executed terms of settlement prior to proceeding with the Hearing, the Parties jointly requested that the Hearing be adjourned and rescheduled as a written settlement hearing to be held on May 8, 2026. The Tribunal was agreeable to this approach, and advised the Parties that all written settlement materials were to be submitted to the Tribunal a week prior to this date.
ORDER
6THE TRIBUNAL ORDERS that:
- the hearing in respect of this matter scheduled for April 28, 2026 is adjourned to a written settlement hearing to be held on May 8, 2026. There will be no further notice; and
- this Member is not seized.
