INTRODUCTION
1This first Case Management Conference (“CMC”) was held to prepare for a Merit Hearing of the appeal by FCHT Holdings (Ontario) Corporation under s. 22(7) of the Planning Act, R. S. O. 1990, c. PO.13, as amended, concerning the failure of the City of Toronto to make a decision within the statutory timeframes on an application for Official Plan Amendment seeking to amend the designation on the property at 110 West Toronto Street from General Employment Area to Mixed Use Area.
NOTICE
2An Affidavit of Service sworn on April 7, 2026, attesting to giving Notice for this proceeding, was marked as Exhibit 1.
STATUS REQUESTS
3No requests for Party or Participant status were received by the Tribunal.
STATUS OF MATTER
4The Parties jointly advised the Tribunal that they are in active discussions about the Appeal and that it is premature to file a Procedural Order or schedule a Merit Hearing at this time. The Parties discussed the timing uncertainty to their discussions and the upcoming schedule for City Council given the municipal election taking place later in the year. As such, the Parties requested the Tribunal adjourn the matter sine die so that it is administratively closed, until such time as they are ready to schedule a second CMC to advance the matter again. The Tribunal agreed and adjourned the matter sine die.
ORDER
5THE TRIBUNAL ORDERS THAT:
a. The Appeal is adjourned sine die.
b. No further notice will be given
c. This Member is not seized but may be spoke to for case management purposes.
