INTRODUCTION
1This is the first Case Management Conference (“CMC”) respecting appeals before the Ontario Land Tribunal (the “Tribunal”), being Tribunal File Nos. OLT-26-000070 and OLT-26-000292/OLT-26-000293. All Appeals have been filed by Ms. Andrea Williams (the “Appellant”).
2Tribunal File No. OLT-26-000070 arises under ss. 17 (24) of the Planning Act (“Act”) and concerns an appeal from the adoption and approval of amendments to the Official Plan and Zoning By-law of the City of North Bay (“City”), being By-law Nos. 2025-107 and 2025-108, enacted on December 9, 2025. The purpose and effect of the amendments is to update planning policies applicable to properties within the Trout Lake Influence Area, including lands adjacent to Trout Lake and its major inflowing streams, to direct future development and redevelopment in a manner that protects and improves water quality while permitting limited development.
3Tribunal File Nos. OLT-26-000292/OLT-26-000293 arise under ss. 53 and 45 of the Act and relate to applications for consent and minor variance concerning lands municipally known as 2230 D Peninsula Road (“Subject Property”). The consent application seeks to create one new lot, and the associated minor variance application seeks relief from certain zoning provisions related to road frontage and access requirements. The Committee of Adjustment for the City refused the applications, and that decision is the subject of the appeal.
Service of Notice of CMC
4There were no issues raised by the Parties with respect to service of the Notice of the Case Management Conference (“CMC”), and no further Notice is required. With respect to Tribunal File No. OLT-26-000070, the Ontario Land Tribunal received the Affidavit of Service of Christopher Drew, sworn April 12, 2026, which was marked as Exhibit 1. With respect to Tribunal File Nos. OLT-26-000292/OLT-26-000293, the Notice of the CMC was issued by the Tribunal. The Tribunal is satisfied that adequate Notice was provided.
HEARING TOGETHER AND SCOPE OF APPEALS
5The Tribunal next addressed a request that the Appeals be heard together. Counsel for the City submitted that the matters relate to the same lands and raise overlapping planning considerations. He advised that, while formal consolidation was not required, it would be procedurally efficient for the matters to be heard together. The Appellant did not oppose this request.
6The Tribunal finds that hearing the matters together will promote the fair and efficient determination of the issues and directs that Tribunal File Nos. OLT-26-000070 and OLT-26-000292/OLT-26-000293 shall be heard together.
7The Tribunal also addressed the scope of the appeal in Tribunal File No. OLT-26-000070. City Counsel submitted that the appeal of Official Plan Amendment and Zoning By-law Amendment By-law Nos. 2025-107 and 2025-108 should be scoped to be site-specific to the Subject Property, noting that there are no other outstanding appeals to the amendments and that the Appellant’s concerns relate specifically to the Subject Property.
8The Appellant advised that she was uncertain about limiting the scope of the appeal and indicated that she may be seeking legal representation as the matter proceeds before the Tribunal. Following submissions from Counsel for the City respecting the effect of scoping and the absence of prejudice to the Appellant. Therefore, the Tribunal having regard to the nature of the Appellant’s interest, the absence of other appeals, and the need to ensure an efficient and focused hearing process, the Tribunal finds that it is appropriate to scope the appeal in Tribunal File No. OLT-26-000070 to be site-specific.
Requests for Status
9Each of the following area residents attended the CMC and were granted Participant status, on consent, for Tribunal File Nos. OLT-26-000070 and OLT-26-000292/OLT-26-000293:

- Jean & Angela Aube; and
- William Davison.
10Following the determination on Participant status, the Tribunal directed that the Participants may resubmit their Participant Statements, in light of the direction that the appeals be heard together. Updated Statements shall be filed with the Tribunal no later than May 19, 2026.
11No one else attended the CMC seeking either Party or Participant status.
MEDIATION AND SETTLEMENT
12The Tribunal explored the possibility of mediation and settlement with the Parties. The Parties both expressed openness to resolution discussions and/or Tribunal-led mediation. They further confirmed that they will keep the Tribunal apprised of any developments with their resolution efforts, which the Tribunal finds satisfactory.
SECOND CMC
13The Tribunal finds that a further CMC is appropriate to permit the Appellant an opportunity to seek legal counsel and to allow the Parties to advance a draft Procedural Order and Issues List, which will assist in defining the issues and estimating the length of the Hearing.
14The Parties shall provide a draft Procedural Order an Issues List to the Tribunal no later than Monday, July 27, 2026, at 12:00 p.m.
15Upon request of the Parties, the Tribunal set a second CMC Hearing, commencing on Tuesday, July 28, 2026, at 10 a.m. by Video Hearing. No further Notice is required.

20As of March 30, 2026, all Hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
ORDER
21The Tribunal Orders that:
The request is granted, and Tribunal File No. OLT-26-000070 and Tribunal File No. OLT-26-000292/OLT-26-000293 shall be heard together, in accordance with Rule 16.3 of the Tribunal’s Rules of Practice and Procedure; and
The date and particulars of the Hearing are as set out above.
