MEMORANDUM OF ORAL DECISION DELIVERED BY A. SAUVE ON APRIL 14, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened a first Case Management Conference (“CMC”) in respect of the Appeal filed by the Appellant pursuant to s. 34(11) of the Planning Act (“Act”), concerning the Municipality’s refusal of a Zoning By-law Amendment (“ZBL”) application to re-zone land from “General Commercial (CG)” to “General Commercial Special Exception Seventeen (CG-17)”.
2The ZBL would permit the establishment of a commercial garage, allowing for the repair and maintenance of vehicles owned by the general public.
3The Tribunal received and marked the Affidavit of Service of the Notice of CMC sworn by Jay Ikjyot Gill as Exhibit 1. There were no issues with the Service of Notice of the CMC, and as such no further notice is required.
4The Municipality did not attend by way of counsel and, instead, Mr. Peter Young, an employee of the Municipality, appeared. Mr. Young advised the Tribunal that the Municipality would be retaining counsel. It appeared that the Municipality was unfamiliar with the Tribunal process.
REQUESTS FOR STATUS
5There were no requests for Party or Participant status.
MEDIATION
6The Tribunal notified the Parties that Tribunal-led mediation is an available option and that additional information can be obtained through the Case Coordinator.
CMC HEARING
7As the Municipality did not have counsel retained, the Parties agreed to adjourn the CMC. Both Parties expect a multi-day Hearing.
PROCEDURAL ORDER AND FURTHER DATES
8The Tribunal scheduled a second CMC to commence on Thursday, June 11, 2026, at 2 p.m. by Video Hearing.
9A draft Procedural Order is to be delivered to the Tribunal no later that Monday, June 1, 2026.
10The deadline for filing a Party Status request or Participant Status request is Monday, June 1, 2026.

15As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
16If the Parties resolve the remaining issues, they are directed to contact the Case Coordinator to set a date for a Settlement Hearing.
