MOTION
1Spurline Developments Inc. (“Appellant”) brings a Motion for an award for costs in favour of the Appellant against the Township of Woolwich (“Township”), filed on July 23, 2025, pursuant to the Tribunal’s Rule 23, in the amount of $99,164.00, plus HST, to reflect the Tribunal’s disapproval of the conduct of the Township’s representatives in these appeals and to partially compensate the Appellant for its costs incurred, plus the Appellant’s costs of this Motion for costs, in the additional amount of $10,000, plus HST; and such further and other relief as this Tribunal considers just.
2The request for costs arises from the Tribunal’s decision in this matter dated June 23, 2025 granting the Appeal.
3Prior to that, on July 18, 2025, the Township filed a Request for Review, pursuant to section 23 of the Ontario Land Tribunal Act, and Rule 25 of the Tribunal’s Rules of Practice and Procedure.
4On September 11, 2025, the Request for Review was granted by the Chair via email, and a re-hearing was Ordered.
5Given that the Request for Review was granted, the decision dated June 23, 2025, was rescinded and a new Hearing has been ordered by the Chair. In the circumstances the Motion for costs is premature.
6In regard to the Motion as this matter is being re-heard at the direction of the Chair, the consideration for the Motion for cost will be determined at the conclusion of the re-hearing by a different Member.
