THESE MATTERS, having come before the Tribunal as a written Hearing to consider a settlement reached between Centre West Management Ltd. and the Corporation of the Township of Essa with respect to the lands legally described as Lot 31, Concession 3, Parts 2, 6 and 14 on 51R-41996 and is known municipally as 4 Bank Street (“subject lands”);
AND THE TRIBUNAL having reviewed the materials filed in support of the settlement, including the affidavit evidence of Celeste Phillips (RPP, MCIP) sworn April 13, 2026, whom the Tribunal herein recognizes as qualified to assist in its deliberations through opinion evidence in the area of land use planning;
AND THE TRIBUNAL having accepted the uncontroverted affidavit evidence of Ms. Phillips, demonstrating that the proposal:
provides a mix of housing options and densities;
efficiently uses land, resources, infrastructure and public service facilities;
is compatible with, and in character with the existing area;
would have no adverse effect on the surrounding land uses;
focuses growth and development to settlement areas within the built boundary of Angus;
