UPON APPEALS having been brought pursuant to sections 22(7) and 34(11) of the Planning Act (“Act”) by YMCA of Greater Toronto and 2764434 Ontario Limited resulting from the failure of the City of Toronto (“City”) to make a decision within the statutory timeframes on applications for an Official Plan Amendment (“OPA”) and a Zoning By-law Amendment (“ZBA”), required to facilitate two 48 storey residential towers containing approximately 1,115 units on lands municipally known as 567 Sheppard Avenue East in the City;
AND THE TRIBUNAL, at this first Case Management Conference (“CMC”) having marked as Exhibit 1 the Affidavit of Service of Christopher J. Drew, sworn on March 23, 2026, attesting to proper Notice having been given for this CMC, and confirming that no further Notice is required for this proceeding;
AND THE TRIBUNAL having received no requests for Party status;
AND THE TRIBUNAL, having received a request for Participant status from David Reid who raised the following concerns:
Mobility (traffic entrance and exit, pedestrian flow);
Public Realm (parkland, transit station access, multi-use trail); and
Built Form (affordable housing, wind impact, Toronto Green Standards).
AND THE TRIBUNAL, having considered the submissions of Mr. Reid, receiving no objections from the Parties, finding that this individual had an interest in the matter and will assist the Tribunal in understanding the potential impacts of the OPA and ZBA on the local community, and granting Participant status to David Reid;
AND THE TRIBUNAL confirming the Parties’ awareness of Tribunal-led mediation and giving direction for the Parties to reach out to the Tribunal’s Case Coordinator in writing if they would like a mediation assessment;
AND THE TRIBUNAL, discussing the Procedural Order (“PO”) and draft Issues List (“IL”), and hearing from the City that an updated and finalized IL would be provided by Friday, May 29, 2026, but that it would not deviate too significantly from the draft IL already provided in advance of this CMC;
AND THE TRIBUNAL, being advised by the City that the revision of the IL would occur once (and if) a transportation expert is hired by the City, with Friday, May 29, 2026 being the latest date by which the IL would be provided, but may be provided earlier and shortly after the expert is hired;
AND THE TRIBUNAL at the CMC having scheduled a four-day Hearing to take place on Tuesday, November 17, 2026 to Friday, November 20, 2026, each day at 10 a.m., by video conference, with the following details:

AND THE TRIBUNAL noting that, as of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction.
