MEMORANDUM OF ORAL DECISION DELIVERED BY David Brown ON April 15, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened a Case Management Conference with respect to an appeal filed by 1912900 Ontario Inc. (“Appellant”) pursuant to s. 34(19) of the Planning Act, R.S.O. 1990, c. P.13, as amended, against the passing of By-law 107-2025 by the Town of Milton (“Town”).
2By-law 107-2025 was one of three by-laws passed by the Town described as housekeeping amendments to the Town’s Comprehensive Zoning By-law 16-2014. By-law 107-2025 included an amendment to the definition of a lot which impacted a development proposal of the Appellant currently in the application process at the Town. The Appellant filed an appeal of the housekeeping amendment as the new definition impacted the Appellant’s development proposal.
3The Tribunal is in receipt of an Affidavit of Service sworn on March 11, 2026 (Exhibit 1), confirming that the Notice for the Appeal was served in accordance with the directions provided by the Tribunal.
STATUS UPDATE
4Counsel updated the Tribunal advising that the Town and the Appellant are in discussion and are optimistic that a resolution of the Appeal can be achieved resulting in a withdrawal of the appeal. Counsel requested that the Appeal not be scheduled for a hearing at this time.
5Town Counsel, Konstantine Stavrakos, advised that he is currently waiting on direction from his client and proposed that a written status update be provided to the Tribunal in 15 days time advising of the status of the appeal.
6Appellant Counsel, Steven Ferri, explained that his client currently has an application before the Town Committee of Adjustment (“CofA”) and the amended definition of a lot in By-law 107-2025 impacts his client’s development proposal. Mr. Ferri explained that subject to the resolution of the appeal his clients will be in a position to withdraw their appeal, however, the withdrawal of the appeal may not occur until the resolution of his client’s application before the CofA.
7The Tribunal did not receive any requests for Party Status or Participant Status in the proceedings.
8The Tribunal adjourns the matter pending the outcome of the negotiations between the Town and the Appellant.
9The Tribunal directs the Parties to provide a written status update to the Tribunal on or before Friday, May 1, 2026, advising of the status of the appeal negotiations.
10In the event that the Parties settle the matter and the Appellant advises that they no longer wish to pursue the Appeal, the Appellant shall provide a letter withdrawing the Appeal on or before Friday, July 31, 2026.
11In the alternative, should the Parties be unable to arrive at a settlement of the Appeal, Counsel shall request the Tribunal to convene a Telephone Conference Call for the purpose of scheduling a Hearing to consider the merits of the appeal.
12There will be no further notice of these proceedings as the two Parties in this matter are in attendance and no others have expressed an interest in the proceedings.
ORDER
13THE TRIBUNAL ORDERS THAT the case management directives set out above are so ordered.
14The Member is not seized of this matter, but, if necessary, may be available for further case management subject to the Tribunal’s calendar.
