MEMORANDUM OF ORAL DECISION DELIVERED BY W. DANIEL BEST ON APRIL 14, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) respecting the next phase of sequential City-wide appeals by the above listed Appellant concerning the passing of Development Charges By-laws by the City.
2This appeal is related to previous appeals filed by the Appellant with the Tribunal as follows:
- OLT-22-003397 related to matters with Development Charges By-law 2014-238
- OLT-22-003398 related to matters with Development charges By-law 2014-264
- OLT-22-003390 related to matters with Development Charges By-law 2015-224
- OLT-23-000097 related to matters with Development Charges By-law 2019-184
3The first phase of the appeals addressed matters under OLT-22-003397 and OLT-22-003398. A Decision was issued on January 24, 2024 that withheld a Final Order pending a further reconciliation of By-laws 2014-238 and 2014-264 in addition to the directions ordered in the Decision and further discussions between the Parties to address outstanding methodology questions.
4Counsel for the Parties advised the Tribunal that there have been ongoing discussions on the matters identified in paragraph [3] and anticipate a resolution by the end of May 2026.
5The Parties have scheduled a series of meetings to address the future phases over the next several months and anticipate providing an update to the Tribunal through the Case Coordinator by Tuesday, September 15, 2026, at which time a subsequent CMC could be scheduled to address matters such as a Procedural Order, scoped Issues List, determining the number of Hearing days, scheduling of a Hearing and determining what (if any) appeals could be heard together in accordance with OLT Rules of Practice and Procedure under Rule 16.3.
NEXT STEPS
6The Parties were directed to provide an update to the Tribunal through the Case Coordinator by Tuesday, September 15, 2026 to determine next steps.
7The Tribunal inquired as to whether there were any other matters to be addressed which might assist in the fair, just, and expeditious resolution of this matter. The Parties indicated there were none.
8The Tribunal thanked all Counsel for their assistance on the matter.
ORDER
9THE TRIBUNAL ORDERS the directions contained above in this Decision.
10The Member is not seized but may be spoken to through the Case Coordinator if any issues arise.
