THE TRIBUNAL having conducted a status conference with the Parties by video hearing on April 22, 2026, concerning certain matters arising from the Tribunal’s Decision issued March 31, 2026;
AND THE TRIBUNAL having considered the submissions made by counsel for the Parties at the above-noted status conference;
THE TRIBUNAL ORDERS THAT:
In the event that the Parties are unable to resolve matters relating to the form and content of the Claimant’s proposed amended Application and Statement of Claim (“Pleadings”), and the requirement for and provision of particulars concerning the allegations made in the Pleadings, then counsel for His Majesty the King in Right of the Province of Ontario, as represented by the Ministry of Transportation for the Province of Ontario shall file a written motion by May 4, 2026, seeking the Tribunal’s determination of any disputes regarding the Pleadings;
The Parties shall deliver to the Tribunal by May 29, 2026, a draft Procedural Order, on consent, which shall include a proposed hearing date in 2027 for this proceeding. Failing such consent, the draft Procedural Order shall clearly delineate all areas of disagreement;
If and as requested by the Parties, the Tribunal shall conduct a written Case Management Conference (“CMC”) which shall be convened on June 5, 2026. The Parties shall deliver written submissions in respect of this written CMC by June 4, 2026; and,
This Vice Chair shall remain seized of this proceeding for ongoing case management purposes, including all motion practice, but shall not be seized in respect of any mediation which may be convened or for the final hearing of this matter.
