THIS MATTER having come before the Ontario Land Tribunal (the “Tribunal”) for a Case Management Conference on November 28, 2025;
AND THE TRIBUNAL having issued the Procedural Order on January 16, 2026, for the purpose of governing the required procedures leading up to the hearing commencing on May 25, 2026;
AND THE TRIBUNAL having received a request, on consent of the Parties, to amend some of the procedural timelines contained in the Procedural Order;
THE TRIBUNAL ORDERS that the following dates from the Procedural Order are amended:
Expert witnesses to have a meeting (paragraph 10) changed from 60 days prior to the hearing (March 26, 2026) to 25 days prior to the hearing (April 30, 2026);
Parties must prepare and file a Statement of Agreed Facts and Issues (paragraph 10) changed from 45 days prior to the hearing (April 10, 2026) to 21 days prior to the hearing (May 4, 2026);
Parties to exchange witness statements (paragraph 13) changed from 30 days prior to the hearing (April 24, 2026) to 10 days prior to the hearing (May 15, 2026);
A participant to provide copies of their participant statement to other parties (paragraph 14) changed from 30 days prior to the hearing (April 24, 2026) to 10 days prior to the hearing (May 15, 2026);
Parties to confirm if all reserved hearing days are required (paragraph 15) changed from 30 days prior to the hearing (April 24, 2026) to 10 days prior to the hearing (May 15, 2026);
Parties to provide copies of their visual evidence to all other parties (paragraph 16) changed from 15 days prior to the hearing (May 11, 2026) to 4 days prior to the hearing (May 21, 2026);
Parties to provide responses to written evidence (paragraph 17) changed from 15 days prior to the hearing (May 11, 2026) to 3 days prior to the hearing (May 22, 2026);
Parties to submit a joint document book (paragraph 18) changed from 15 days prior to the hearing (May 11, 2026) to 3 days prior to the hearing (May 22, 2026);
