UPON APPEALS having been brought pursuant to sections 22(7) and 34(11) of the Planning Act (“Act”) by 895 Lawrence Avenue East Inc. (“Applicant”) resulting from the failure of the City of Toronto (“City”) to make a decision within the statutory timeframe on applications for an Official Plan Amendment and a Zoning By-law Amendment, required to facilitate a three-building development on lands known municipally as 895 Lawrence Avenue East (“Subject Property”);
AND THE TRIBUNAL, at this second Case Management Conference (“CMC”) confirming that a prior CMC took place on November 6, 2025, wherein it was confirmed that no further Notice was required as adequate Notice had been served, and that Don Mills Residents Inc. (“DMRI”) group had been added as a Party and 10 participants had been added to the proceeding;
AND THE TRIBUNAL, being advised by the Applicant and the City that a settlement agreement had been reached between them;
AND THE TRIBUNAL, being advised by DMRI that it did not oppose the settlement but also did not endorse it and wished to provide comments for the Tribunal’s consideration;
AND THE TRIBUNAL, having considered the submissions of the Parties and determining that:
The Tribunal would schedule a Hearing in writing to allow the Parties to present the settlement agreement for its consideration;
The Parties will provide an Affidavit from a witness in support of the settlement agreement, as well as the draft instruments that the Tribunal is to consider; and
DMRI and the Participants can provide their concerns and submissions to the Tribunal and the other Parties for consideration by Thursday, April 30, 2026.
AND THE TRIBUNAL, at the CMC having scheduled a Hearing to take place on Friday, June 12, 2026, in writing to consider the settlement agreement;
AND THE TRIBUNAL, noting that, as of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content;
NOW THEREFORE,
THE TRIBUNAL ORDERS THAT:
A Hearing in writing is scheduled as detailed above.
The added Party, Don Mills Residents Inc., and the Participants are to provide their submissions to the Applicant, 895 Lawrence Avenue East Inc., the City of Toronto, and the Tribunal by Thursday, April 30, 2026.
