THESE MATTERS having come before the Tribunal at a CMC was heard on May 1, 2025;
AND THE TRIBUNAL issued a written decision and order, dated May 22, 2025 (the “Order”), allowing the appeals in part;
AND THE TRIBUNAL has received a request from the Parties, on consent, that the Tribunal vary the Order so as to implement the revised ZBA;
THE TRIBUNAL ORDERS that the Order is hereby varied by adding Attachment 1 of the Order, attached hereto as Appendix 1;
AND THE TRIBUNAL FURTHER ORDERS that except as set out herein, the Order shall remain unchanged;
AND THE TRIBUNAL FURTHER ORDERS that in the event there are issues arising from the implementation of this Order, the Tribunal may be spoken to.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.

The following is to be added to By-law No. ______________being a By-law which served to rezone the property known municipally as 78 Fire Route 50A (Burleigh Ward), Township of North Kawartha.
Subsection 3
Notwithstanding the provisions of Section 3.30 (a), the accessory building (garage), located in the east part of the property shall have a water-yard (east) of 24.28 metres.
Notwithstanding the provisions of Section 31 (d) (i), the total coverage of accessory buildings shall be 5.6%.
