UPON APPEALS brought by the Appellants, listed at Attachment 1, filed pursuant to section 17(36) of the Planning Act regarding the adoption of Official Plan Amendment No. 59 by Council of the Municipality of Middlesex Centre;
AND THE TRIBUNAL having scheduled an in-person Settlement Motion to be heard on the present day concerning the Appeals by 1571145 Ontario Limited, Tridon Properties Ltd., Paisley Hill Ltd., 2817053 Ontario Limited, Watermark Komoka 2021 Inc. (c/o York Developments), Farhi Holdings Corporation and Farhi Farming Corporation, all of which are uncontested between these parties, the Municipality of Middlesex Centre, and the County of Middlesex (all of whom are hereafter referred to as the “Consensus Parties”), but contested by the Appellant Sifton Properties Limited (“Sifton”);
AND THE TRIBUNAL having heard disagreement between Sifton and the Consensus Parties in terms of how to proceed with present in-person hearing, the parties all expressing that their arguments will be highly nuanced, and the Consensus Parties suggesting that the Motion would be better served if it was done in writing, to enable the parties to firmly express the nuanced nature of their submissions;
AND THE TRIBUNAL having heard that Sifton preferred to have the Motion proceed in person as scheduled;
AND THE TRIBUNAL having found that the submissions will be highly nuanced and the motion would consequently be better served if it was done in writing;
THE TRIBUNAL ORDERS THAT the present Settlement Motion will be done in writing, with the following submission dates:
The Consensus Parties will jointly serve and file their motion materials, including a factum of no more than 30 pages, by Friday, January 16, 2026;
Sifton will serve and file its Responding motion materials, including a factum of no more than 25 pages, by Friday, January 30, 2026; and
The Consensus Parties will jointly serve and file their Reply motion materials, if any, including a factum of no more than 10 pages, by Monday, February 9, 2026.
The Member is not seized but may be spoken to through the Case Coordinator if any issues arise.
