MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON MARCH 24, 2026 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) for the above-noted matter. Pegasus Development Corporation (“Appellant”) filed an appeal against the County of Lanark’s (“County”) failure to make a decision within the statutory time frame for the Appellant’s application to permit a private road to service 77 single detached dwellings, with respect to the property Block 213, Plan 27M-81 Lanark. The appeal was brought pursuant to s. 51(34) of the Planning Act.
2The Affidavit of Service of notice of CMC on file was marked as Exhibit A.
PARTY/PARTICIPANT REQUESTS
3There was a party status request received from the Town of Carleton Place. The Tribunal granted party status to the Town on consent of the parties.
DRAFT PROCEDURAL ORDER
4Counsel informed the Tribunal that the County, Town and Appellant will need time to frame the issues and requested that a CMC be scheduled.
MEDIATION
5The Parties regard mediation as premature, have no instructions, but are open to it.
DISPOSITION
6The Tribunal will schedule a second CMC as requested since the procedural order (“PO”) and issues list (“IL”) are not available. There will be no further notice, and the Member is not seized.
7The Tribunal directs that the PO, with the IL, be forwarded to the Case Coordinator by Tuesday, September 29, 2026.
SECOND CMC
8The second CMC is scheduled to proceed by video on Tuesday, October 13, 2026 at 10 a.m.
