UPON APPEALS having been brought pursuant to sections 22(7) and 34(11) of the Planning Act (“Act”) by 705 Kingston Road Ltd., resulting from the failure of the City of Pickering (“City”) to make a decision within the statutory timeframe on an application for an Official Plan Amendment and Zoning By-law Amendment in relation to the property located at 705 Kingston Road in the City;
AND THE TRIBUNAL, having conducted this first Case Management Conference (“CMC”) at which it concluded no further notice would be required, upon being provided with an Affidavit of Service dated March 4, 2026, confirming that proper notice of this CMC was given;
AND THE TRIBUNAL, having received no written requests for Party or Participant Status in advance of the CMC, nor any requests for status at the CMC;
AND THE TRIBUNAL, having been advised by the Parties (listed in Attachment 1 to this Order) that they are currently engaged in productive without prejudice discussions aimed at resolving or scoping the issues under appeal and are not in a position to request hearing dates at this time;
AND THE TRIBUNAL having been asked to schedule a second CMC in June 2026, the purpose of which will be to provide substantive updates to the Tribunal on the aforementioned discussions and, if necessary, schedule a hearing on the merits;
AND THE TRIBUNAL having scheduled a second CMC to be held by video hearing on:

As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
AND THE TRIBUNAL, having directed the Parties to submit a draft Procedural Order and detailed Issues List to the Tribunal for its review and approval no later than noon on Friday, June 12, 2026;
AND THE TRIBUNAL, having reminded the Parties of the availability of Tribunal-assisted mediation;
NOW THEREFORE,
THE TRIBUNAL ORDERS THAT:
A second Case Management Conference is scheduled as detailed above;
The Parties are directed to submit a draft Procedural Order and Issues List no later than Friday, June 12, 2026;
This Member is not seized, but may be available for additional case management should the Tribunal’s calendar permit.
