MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON MARCH 25, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) for the above-noted matter. The Appellants have filed appeals against the City’s adoption of Official Plan Amendment (“OPA”) OP 2023-012 (“OPA 12”) under s. 17(24) of the Planning Act in respect of the lands municipally known as 0 Queen Street West and 8525 Mississauga Road.
2The Affidavit of Service on file was marked as Exhibit A.

3There were no Party or Participant status requests received.
DRAFT PROCEDURAL ORDER
4The Appellants’ counsel, Mr. Flowers, provided an update of this OPA 12 appeal matter. This appeal relates to portions of OPA 12 as listed in the Appellants’ letter enclosing Notice of Appeal.
5He explained that there was a related matter, Tribunal File No. OLT-23-001209, where the Appellant appealed portions of the City’s OPA 2006-254 (“OPA 254”). That matter was held in abeyance, pending the Appellants’ site specific OPA and Zoning By-law Amendment (“ZBA”) applications to the City.
6The site specific OPA and ZBA have been filed with the City. The Appellants then filed resubmissions of the site specific OPA and ZBA and had recently filed notices of appeal of same.
7Counsel for the Appellants, with the concurrence of City’s counsel, Mr. Rea, sought a subsequent CMC date to bring the related file and the recently filed appeals together, as these matters are intertwined. The goal is to have a common CMC where these matters could be dealt with, as regards, the Draft Procedural Order (“DPO”), the issues, and as to whether the matters could be heard together, etc.
8The City noted that, with respect to the OPA 12, the City’s intention was to treat the non-appealed parts of the OPA as being in-force by operation of law. Appellants’ counsel was clear in that the Appellants’ Notice of Appeal had clearly described the portions and parts of the OPA that were appealed. As such, the appealed portions of the OPA remain the subject matter of the appeals by the Appellants.
9Counsel requested a one-day CMC to be scheduled in mid-May, with the DPO relating to the aforementioned matters being provided by the next CMC.
10The Tribunal notes that the request for a common CMC is reasonable. The file OLT-23-001209 and the current file OLT-25-000864 will be scheduled with the next CMC on May 20, 2026. As for the recently filed site specific OPA and ZBA appeals, municipal records have not been received by the Tribunal and no file reference numbers assigned. The Tribunal will alert scheduling to link the CMC date with the new appeals when received.
MEDIATION
11The Parties regard mediation as premature at this juncture but will be open to mediation.
DISPOSITION
12The Tribunal will schedule a one-day CMC. There is no further notice, and the Member is not seized.
13The Tribunal directs that the DPO, together with the Issues list, be forwarded to the Case Coordinator by Monday, May 11, 2026.
Subsequent CMC
14The subsequent CMC is scheduled to proceed by video on Wednesday, May 20, 2026 at 10 a.m.
