MEMORANDUM OF ORAL DECISION DELIVERED BY STEVEN T. MASTORAS ON MARCH 23, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION AND PRELIMINARY MATTERS
1This matter is a Case Management Conference (“CMC”) scheduled to consider a Procedural Order and Issues List (“PO/IL”) associated with a Phase 1 Transportation Hearing (“P1TH”), recently scheduled to commence on August 10, 2026, for ten days, resulting from a Motion for Direction Decision (“Motion Decision”) (February 17, 2026).
2As landowners in the Weston and Highway 7 Area (“W7 Area”) properly referenced in the Title of Proceedings above, four of the Parties are all Site Specific Appellants (“Appellant Parties”) with different appeals also identified above under Tribunal Lead Case File Nos. OLT-25-000288 (“PEM Weston Appeals”), OLT-25-000733 (“SKY Appeals”), OLT-25-000892.
3Each of the Appellant Parties have independent Merit Hearings scheduled with the Tribunal, commencing later in 2026, and early 2027, respectively in order of the Tribunal Case Files noted for ease of reference:
The PEM Weston Appeals are now scheduled for a Merit Hearing on Monday, October 26, 2026 (for ten-days), resulting from the Tribunal Motion Decision of February 17, 2026.
The SKY Appeals were recently scheduled for a Merit Hearing, commencing on Monday, November 30, 2026 (for ten-days).
The Kingsmoor Appeals were recently scheduled for a Merit Hearing commencing on Tuesday, February 16, 2027 (for nine-days).
The Gallu Appeals, were also just recently scheduled for a Merit Hearing commencing on Monday, May 17, 2027 (for ten-days). Gallu, has also recently corresponded with the Tribunal (March 17, 2026), that they have consented to be fully-engaged as a Party during the P1TH process. This was in response to a Motion for Direction from the City, that was expected to be heard at today’s CMC, which has now been resolved between the Parties.
4Also, on consent of the Parties, the Tribunal marked the following Exhibits for the record, in relation to the City’s Motion:
- City Motion Record and Affidavit of Service (February 27, 2026); and,
- Gallu Responding Motion and Correspondence Confirming Consent (March 16, 2026).
STATUS REQUESTS AND DIRECTIONS
5In the lead up to this CMC, having allowed some time for the Motion Decision, and information, regarding all relevant Hearing dates to circulate with area landowners in the W7 Area, three separate written Participant Status Requests were submitted to the Tribunal in advance of this CMC, from the following landowners below:
Marino On 7 Inc. (“Marino On 7”), as the owner of lands municipally located at 3883 Highway 7 in the City, located in the southwest quadrant of the W7 Area (“Marino On 7 Lands”). As represented by Gerard Borean (Parente, Borean), given that the Marino On 7 Lands are within the Weston 7 Secondary Plan (“W7SP”) and are also within the City’s Transportation Master Plan (“TMP”) study area, they intend to correspond with Tribunal in relation to any commonality of issues, in the course of the P1TH, in their capacity as a Participant.
Dev-West Properties Inc. (“Dev-West”) is the registered owner of the lands municipally known as 7600 Weston Road (“Dev-West Lands’) in the City, located at the southwest corner of Weston Road and Highway 7. As represented by Matthew Helfand (Aird & Berlis), Dev-West has currently submitted an Official Plan Amendment (“OPA”), and Zoning By-law Amendment applications, respectively (“Dev-West Applications”) before the City for review, consisting of a high-rise, mixed-use proposal. Dev-West submits that as the largest parcel located in the southwest quadrant of the W7SP, it also intends to provide related correspondence as deemed appropriate, as a Participant.
Canadian Tire Properties Inc. and Canadian Tire Real Estate Limited, (collectively, “Canadian Tire”) the owner and tenant of the lands municipally known as 3850 Hwy 7, Woodbridge (the “CT Lands”). As represented by Adrianna Pilkington (Cassells, Brock & Blackwell), the CT Lands form part of the Weston 7 Landowners Group, and Canadian Tire has an interest in its ongoing operations, and future redevelopment of the CT Lands, which may also correspond with the Tribunal, as a Participant.
6All Participant requests are seeking to submit correspondence at the appropriate time in the lead-up to the P1TH, to assist the Tribunal in reaching a decision in the P1TH process, and the Parties agreed to ensure that the opportunity for Participant input will be acknowledged in the draft Final PO/IL.
7Noting consent from all Parties to these requests, the Tribunal conferred Participant status on Marino On 7, Dev-West, and Canadian Tire, respectively.
PROCEDURAL ORDER AND ISSUES LIST
8Although the original date for the provision of a draft PO/IL was scheduled for submission to the Tribunal, on or before Monday, March 9, 2026, a series of requests for more time between the Parties was submitted, on consent of the Parties, to allow for further scoping of Issues, and Tribunal direction allowed for this to occur.
9Just prior to the commencement of this CMC, a draft PO/IL was circulated for consideration of the Tribunal, on consent of all of the Parties, and their cooperation in this matter was welcomed by the Tribunal.
10Following some further interaction between Parties at the CMC, the draft Final PO/IL was submitted and approved by the Tribunal on March 24, 2026. Therefore, the Tribunal directed that the PO/IL, submitted on consent of the Parties, is hereby approved, and marked below to this Decision, as Schedule A.
11Finally, the Tribunal reiterates its appreciation of the respectful cooperation between Counsel for all of the Parties present. It notes further that should there be a desire for Tribunal-led mediation related to any matter in these circumstances, if requested, on consent, to help expedite any resolution of issues.
ORDER
12THE TRIBUNAL ORDERS THAT the Procedural Order and Issues List is hereby approved and will guide the Parties in the lead up to the Phase 1 Transportation Hearing, as scheduled to commence on Monday, August 17, 2026.
13All other directions in this Decision are so ordered.
14The Member is not seized on this matter, however, remains available to assist the Parties in the lead up to the Phase 1 Transportation Hearing.

PROCEDURAL ORDER
- The Tribunal may vary or add to the directions in this procedural order at any time by an oral ruling or by another written order, either on the parties’ request or its own motion.
Organization of the Hearing
The video hearing will begin on Monday, August 10, 2026 at 10:00 a.m.
The parties’ initial estimation for the length of the hearing is (ten) 10 days. The parties are expected to cooperate to reduce the length of the hearing by eliminating redundant evidence and attempting to reach settlements on issues where possible. The procedural order deadlines are generally found in Attachment 1.
The parties and participants identified at the case management conference are set out in Attachment 2.
The issues are set out in the Issues List attached as Attachment 3. There will be no changes to this list unless the Tribunal permits, and a party who asks for changes may have costs awarded against it.
The order of evidence shall be as set out in Attachment 4 to this Order. The Tribunal may limit the amount of time allocated for opening statements, evidence in chief (including the qualification of witnesses), cross-examination, evidence in reply and final argument. The length of written argument, if any, may be limited either on the parties’ consent, subject to the Tribunal’s approval, or by Order of the Tribunal.
Any person intending to participate in the hearing should provide a mailing address, email address and a telephone number to the Tribunal as soon as possible – ideally before the case management conference. Any person who will be retaining a representative should advise the other parties and the Tribunal of the representative’s name, address, email address and the phone number as soon as possible.
Any person who intends to participate in the hearing, including parties, counsel and witnesses, is expected to review the Tribunal’s Video Hearing Guide, available on the Tribunal’s website.
A party, participant, or witness who intends to submit document(s) to the Tribunal must include a declaration within each submitted document if generative AI was used to create or generate content. A declaration is not required if AI was used to merely suggest changes, provide recommendations, or critique content already created by a human who then considered and manually implemented the changes.
Requirements Before the Hearing
A party who intends to call witnesses, whether by summons or not, shall provide to the Tribunal and the other parties a list of the witnesses and the order in which they will be called. This list must be delivered on or before May 1, 2026, and in accordance with paragraph 22 below. A party who intends to call an expert witness must include a copy of the witness’ Curriculum Vitae and the area of expertise in which the witness is proposed to be qualified.
Expert witnesses in the same field shall have a meeting on or before May 15, 2026, and use reasonable efforts to try to resolve or reduce the issues for the hearing. Following the experts’ meeting the expert witnesses must prepare and file a Statement of Agreed Facts and Issues with the Tribunal’s Case Co-ordinator on or before May 29, 2026.
An expert witness shall prepare an expert witness statement, which shall list any reports prepared by the expert, or any other reports or documents to be relied on at the hearing. Copies of this expert witness statement must be provided as in paragraph 14 below. Instead of a witness statement, the expert may file his or her entire report if it contains the required information. If this is not done, the Tribunal may refuse to hear the expert’s testimony.
Expert witnesses who are under summons but not paid to produce a report do not have to file an expert witness statement; but the party calling them must file a brief outline of the expert’s evidence as in paragraph 14 below. A party who intends to call a witness who is not an expert must file a brief outline of the witness’ evidence, as in paragraph 14 below.
On or before June 12, 2026, the parties shall provide copies of their witness and expert witness statements to the other parties and to the Tribunal’s Case Co-ordinator and in accordance with paragraph 23 below.
On or before June 12, 2026, a participant shall provide copies of their written participant statement to the Tribunal and the other parties in accordance with paragraph 23 below. A participant cannot present oral submissions at the hearing on the content of their written statement, unless ordered by the Tribunal.
On or before July 3, 2026, the parties shall confirm with the Tribunal if all the reserved hearing dates are still required.
On or before July 31, 2026, the parties shall provide copies of their visual evidence to all of the other parties in accordance with paragraph 23 below. If a model will be used, all parties must have a reasonable opportunity to view it before the hearing.
On or before July 20, 2026, the parties may provide to all other parties and the Tribunal’s Case Co-ordinator a written response to any written evidence in accordance with paragraph 23 below.
The parties shall cooperate to prepare a joint document book which shall be shared with the Tribunal’s Case Co-ordinator on or before July 31, 2026.
A person wishing to change written evidence, including witness statements, must make a written motion to the Tribunal. See Rule 10 of the Tribunal’s Rules with respect to Motions, which requires that the moving party provide copies of the motion to all other parties 15 days before the Tribunal hears the motion.
A party who provides written evidence of a witness to the other parties must have the witness attend the hearing to give oral evidence, unless the party notifies the Tribunal at least 7 days before the hearing that the written evidence is not part of their record.
The parties shall prepare and file a preliminary hearing plan with the Tribunal on or before August 4, 2026, with a proposed schedule for the hearing that identifies, as a minimum, the parties participating in the hearing, the preliminary matters (if any to be addressed), the anticipated order of evidence, the date each witness is expected to attend, the anticipated length of time for evidence to be presented by each witness in chief, cross-examination and re-examination (if any) and the expected length of time for final submissions. The parties are expected to ensure that the hearing proceeds in an efficient manner and in accordance with the hearing plan. The Tribunal may, at its discretion, change or alter the hearing plan at any time in the course of the hearing.
All filings shall be submitted electronically unless otherwise directed. Electronic copies may be filed by email, an electronic file sharing service for documents that exceed 10MB in size, or as otherwise directed by the Tribunal. The delivery of documents by email shall be governed by the Tribunal’s Rule 7.
No adjournments or delays will be granted before or during the hearing except for serious hardship or illness. The Tribunal’s Rule 17 applies to such requests.

Transportation Impact Studies
(1) Are the transportation impacts anticipated to be generated individually and collectively by the proposed developments arising from: (i) the PEM (Weston) Limited Partnership and PEM (Weston) GP Inc. appeals (OLT-25-000288); (ii) the 2371933 Ontario Inc (Sky Properties) appeals (OLT-25-0000733); (iii) the Kingsmoor Developments Inc. appeals (OLT-25-000892); and (iv) the Gallu Construction Inc. appeals (OLT-26-00088), (collectively, the “Proposed Developments”), appropriate?
(2) Are the Transportation Studies completed in support of each of the Proposed Developments adequate and do they follow an acceptable methodology?
Weston 7 TMP
(3) What is the scope, relevance, applicability and potential implications, if any, of the Weston 7 Transportation Master Plan (the “TMP”), including as it relates to the reference of 15,840 people and 10,051 jobs, individually and collectively on: (i) the PEM (Weston) Limited Partnership and PEM (Weston) GP Inc. appeals (OLT-25-000288); (ii) the 2371933 Ontario Inc (Sky Properties) appeals (OLT-25-0000733); (iii) the Kingsmoor Developments Inc. appeals (OLT-25-000892); and (iv) the Gallu Construction Inc. appeals (OLT-26-00088)?
Transportation Capacity & Transportation Improvements
(4) Is there sufficient transportation capacity in the Weston & 7 Secondary Plan area and beyond to accommodate the Proposed Developments, individually or collectively, based on: (i) existing transportation constraints; (ii) forecasted transportation constraints without City and/or Regional proposed transportation infrastructure; and/or (iii) forecasted transportation constraints with City and/or Regional proposed transportation infrastructure?
(5) If not, what transportation infrastructure improvements are required to accommodate the Proposed Developments? Specifically: (i) Should the Proposed Developments be required to secure for any required on-site transportation improvements before each respective Proposed Development proceeds? (ii) Do the Proposed Developments, individually or collectively, propose any modifications to the TMP proposed transportation network, and if so, are those modifications appropriate? (iii) If the transportation improvements required to accommodate the Proposed Developments, individually or collectively, go beyond their respective subject sites, how, if at all, should the Proposed Developments be required to secure for these transportation improvements?
Implementation
(6) What land use controls, if any, should be imposed on the official plan amendment and/or zoning bylaw amendment sought by each of the Proposed Developments, from a transportation perspective, if the OLT ultimately approves the Proposed Developments in their current form, or as may be modified, following a phase 2 hearing for each of the Proposed Developments?
