MEMORANDUM OF ORAL DECISION DELIVERED BY David Brown ON March 18, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The Tribunal convened a fourth Case Management Conference (“CMC”) with respect to multiple appeals filed regarding two matters in the City of Brampton (“City”). The first being appeals filed pursuant to s. 17(24) of the Planning Act, R.S.O. 1990, c. P.13, as amended (“Planning Act”) against the approval of an Official Plan Amendment (“OPA”) by the City that introduced interim policies for Major Transit Station Areas (“MTSA”), and the second being appeals filed pursuant to s. 17(36) of the Planning Act against the City’s approval of a new City Official Plan (“Brampton Plan”).
STATUS UPDATE
2Mr. Bruce Engell, counsel for the City, provided an overview of the status of the appeals explaining that the Tribunal recently granted a Motion resulting in the partial approval of portions of the Brampton Plan and the resolution of a number of the appeals. Mr. Engell advised that the City is now addressing specific appeals and issues in an effort to negotiate and resolve further appeals. The City is preparing an updated annotated version of the Brampton Plan to be available to the public. Mr. Engell advised that the City will continue working with the Appellants with a goal of finding a resolution of the remining appeals.
3Mr. Engell advised that there is a Settlement in the works with the Northwest Brampton Landowners Group and it is proposed to file a Motion seeking the approval of the Settlement once it has been finalized. Mr. Engell proposed that the Motion be considered by way of a written motion, subject to the Tribunal’s direction.
4The Tribunal consented that the Motion can be considered as a written motion to be served in accordance with the Tribunal’s Rules of Practice and Procedure.
5Mr. Engell advised that a further Motion is being contemplated to address what he described as ‘scoping of the issues’ as it applies to the Mixed-Use Employment Area policies.
6Mr. Lee English, Counsel for Soneil Markham Inc., Soneil Mississauga Inc., and Soneil Oakville Inc. (together “Soneil”), responded that the Motion referred to by the City is not a motion to scope the appeals, but a motion to dismiss, and Soneil has concerns with the City’s approach. Mr. English advised that the Soneil has concerns with the language of the Mixed-Use Employment Area policies and the City has not engaged in any discussions with Soneil at the direction of City Council.
7The Tribunal reminded the Parties that the Tribunal expects that Parties explore settlement opportunities before bringing a matter before the Tribunal for adjudication.
CONSOLIDATION
8At the previous CMC, the Tribunal was requested to defer the consideration of whether the appeals should be consolidated, heard together, or heard concurrently. Mr. Engell explained that the resolution of the appeals of the Brampton Plan may have the effect of rendering the interim MTSA policies contained in the OPA moot and, by extension, the OPA would be unnecessary. As a result, there may be no further OPA related appeals before the Tribunal. He requested that the matter be addressed at the next CMC, should it be necessary.
9Mr. Leo Longo, Counsel for Centennial Mall Brampton Ltd., noted that the City recently adopted a Secondary Plan for the Queen Street corridor and passed a new Comprehensive Zoning By-law, both of which his client has appealed on a site-specific basis. He advised that his client may be requesting that the site-specific appeals be consolidated with the appeals currently before the Tribunal.
10The Tribunal directs that the two appeals will continue to be joined for administrative purposes, thereby creating efficiencies in determining the procedural matters relating to the organization of the appeals. The Tribunal defers consideration of the consolidation or hearing together of the appeals to the next CMC.
NEXT STEPS
11The Parties proposed that a further CMC be scheduled in July 2026 to address the above-mentioned items.
12The Tribunal supports the Parties’ path forward and scheduled a further CMC to be conducted on Wednesday, July 8, 2026, at 10 a.m. by Video Hearing.
