MEMORANDUM OF ORAL DECISION DELIVERED BY D. CHIPMAN ON MARCH 3, 2026, AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This decision arises from a Case Management Conference ("CMC") pertaining to the appeals filed by Inaria Burlington Inc. The Appellant seeks to develop a 28-storey mixed use building and a six-storey parking structure ("Proposed Development") on the lands municipally known as 2030 Caroline Street ("Subject Property"), in the City.
2To facilitate the Proposed Development, the Appellant applied for an Official Plan Amendment ("OPA") and Zoning By-law Amendment ("ZBA"). City Council refused the applications, stating that the Proposed Development is, inter alia, within a natural hazard and lacks safe access.
3The Tribunal received a late request from the Parties seeking to adjourn this CMC sine die. The Tribunal thought it advantageous to continue with the CMC to understand more fully where this matter stands. The Tribunal heard the Environmental Assessment ("EA") for Lower Rambo Creek, initiated by the City, is still underway and the results of the EA may be affected by the new hydrological modelling that is currently being prepared by Conservation Halton, both of which will have a direct impact on the Subject Property. The Parties informed the Tribunal that the EA is expected to be completed early 2027. Both the City's and HCRA's counsel confirmed this information.
NEXT STEPS
4As the request was brought on consent, the Tribunal adjourned the matter sine die. The Parties agreed that, should a request for a further CMC be required, it would be scheduled with at least 60 days notice and subject to the Tribunal's availability.
5The Tribunal directed the Parties to provide a written status update on the progress of this matter by the end of year (2026).
