Decision
THIS MATTER having come before the Tribunal;
AND THE TRIBUNAL having been advised by Activa Holdings Inc., the owner of the lands known municipally as 485 Huron Road, in the City of Kitchener, which are the subject of Official Plan Amendment No. 42 to the City of Kitchener Official Plan, is withdrawing its request to have a warehouse added as a permitted use on the subject lands within the policies of the Kitchener Official Plan;
THE TRIBUNAL ORDERS that pursuant to the Tribunal’s authority under s.9(1) of the Ontario Land Tribunal Act, the appeal by the Six Nations of the Grand River Band of Indians is allowed and Amendment No. 42 to the Official Plan for the City of Kitchener is not approved.
