MEMORANDUM OF ORAL DECISION DELIVERED BY T.F. NG ON MARCH 13, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This Decision arises from the second Case Management Conference (“CMC”) for the above-noted matter. The Appellant has appealed under s. 22(7), 34(11) and 51(34) of the Planning Act, R.S.O. 1990, c. P.13, as amended (“Act”), for the non-decision of the City regarding an Official Plan Amendment (“OPA”), Zoning By-law Amendment (“ZBA”) and proposed Plan of Subdivision (“DPS”) (together the “Applications”) concerning the municipal address of 285 and 295 Queen Street East, in the City (“Subject Property”).
DRAFT PROCEDURAL ORDER
2The Tribunal scheduled this second CMC for the purposes of considering a Procedural Order (“PO”) and scoped Issue List (“IL”) and to consider potential hearing dates. The PO with IL has been filed and parties requested a six-week hearing to be scheduled since a total number of 18 witnesses may be called.
MEDIATION
3The Parties have no instructions, but will be open to considering mediation.
DISPOSITION
4The Tribunal will schedule a six-week Hearing. There is no further Notice, and the Member is not seized.
5The Tribunal directs that the PO with the deadlines filled in, together with the Issues List, be forwarded to the Case Coordinator by March 27, 2026.
HEARING
6The Hearing is scheduled to proceed by video at 10 a.m. from Monday, January 11, 2027, to Friday, February 19, 2027. The Tribunal will not sit on Jan 25, 2027 and on February 15, 2027.
