MEMORANDUM OF ORAL DECISION DELIVERED BY P. TOMILIN ON MARCH 3, 2026 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of the appeal by 20 Leslie Street Inc. (“Appellant”), arising from the failure of the City of Toronto (“City”) to make a decision within the applicable statutory timeline for the Official Plan Amendment (“OPA”), pursuant to ss. 22(7) of the Planning Act (“Act”), for the property located at 20 Leslie Street (“subject property”).
2The Appellant is seeking to redesignate the subject property to permit a mix of residential and non-residential uses.
3The Tribunal marked the Affidavit of Service as Exhibit 1.
PARTY STATUS REQUEST
4In advance of the CMC, the Tribunal received one Party Status request from Atura Power (“Atura”).
5Atura is a “specified person” as defined in s. 1(1) of the Act, because it is a “corporation operating an electric utility in the local municipality or planning area to which the relevant planning matter would apply”.
6Atura owns and operates the Portlands Energy Centre (“PEC”), a 550 MW natural gas-fired combined cycle power generating station located on 12 hectares of land at 470 Unwin Avenue in the Port Lands industrial area of east downtown of the City and is located approximately 900 metres from the subject property. The ongoing and uninterrupted operation of the PEC is integral to delivering power to the City.
7The Tribunal granted Party Status request to Atura.
PARTICIPANT STATUS REQUEST
8Prior to the CMC, the Tribunal received one Participant Status request from Jonathan Giles. Mr. Giles is concerned about the impact of re-zoning on jobs and surrounding businesses, as well as shadowing onto his property from the proposed development comprising of a new building containing two towers with heights of 25 and 35 storeys with a shared six-storey podium.
9The Tribunal granted Participant Status request to Mr. Giles.
MEDIATION
10The Tribunal reminded the Parties that if they are interested in Tribunal-led mediation, they should reach out to the assigned Case Coordinator.
HEARING, PROCEDURAL ORDER AND ISSUES LIST
11The Parties requested a nine-day Hearing to be scheduled in Q4 of 2026.
12Draft Procedural Order and Issues List are due on or before, Monday, March 30, 2026.
13A nine-day Hearing is scheduled to proceed by video on Monday, November 2, 2026 at 10 a.m. continuing to Friday, November 13, 2026.
