THIS MATTER having come on for public hearing and the Ontario Land Tribunal (“Tribunal”) having issued a Decision on March 9, 2023 allowing the appeal in part to the Zoning By-law 2010-050 and to the draft plan of subdivision;
AND THE TRIBUNAL pursuant to subsection 51(56.1) of the Planning Act having delegated approval authority for the subdivision to the Town of Halton Hills but allowing the parties to return to speak to the Tribunal if any difficulties arose;
AND THE TRIBUNAL having received a request from 2147925 Ontario Inc. (Eden Oak), for a one (1) year extension to the lapsing date of March 9, 2026 and for approval of minor revisions to the draft plan of subdivision and related conditions of approval;
AND THE TRIBUNAL having received consent of the Town of Halton Hills, supporting the request for the one (1) year extension;
THE TRIBUNAL ORDERS that the following requests are hereby approved: extension of the lapsing provisions on the draft plan of subdivision for one (1) year to March 9, 2027; the revised draft plan of subdivision attached to this Order as Attachment 1; and the conditions of draft plan approval are modified as attached to this Order as Attachment 2;
AND THE TRIBUNAL FURTHER ORDERS that it may be spoken to in the event that there are any issues arising from the implementation of this Order.
