THIS MATTER having came before the Tribunal for the initial Case Management Conference (CMC) on May 5, 2012, and a Settlement Hearing on June 19, 2023;
AND THE TRIBUNAL having heard and received written expert opinion evidence in the area of land use planning in support of a settlement between the parties;
AND THE TRIBUNAL having approved the settlement pursuant to the Decision issued by the Tribunal on November 28, 2024;
THE TRIBUNAL MAKES AN INTERIM ORDER THAT:
- Official Plan Amendment No. 144 to the Official Plan of the City of Toronto shall come into effect for all lands except 99, 109, 116, 116R and 126-142 Ryding Avenue and 90 Ethel Avenue and that the City Clerk be notified, in accordance with s. 17(30), 17(30.1) and 17(50) of the Planning Act, that the decision of Council with respect to Official Plan Amendment No. 144 for the all lands except 99, 109, 116, 116R and 126-142 Ryding Avenue and 90 Ethel Avenue will become final and binding;
- Zoning By-law 1170-2011 is in full force and effect for all lands except 99, 109, 116, 116R and 126-142 Ryding Avenue and 90 Ethel Avenue in accordance with s. 34(31) of the Planning Act; and
- The relief in paragraphs 1 and 2 above are without prejudice to any position the parties may take on a procedural or substantive matter with regards to the site-specific appeal respecting 99, 109, 116, 116R and 126-142 Ryding Avenue and 90 Ethel Avenue.
AND THE FURTHER TRIBUNAL ORDERS THAT:
- Zoning By-law 1169-2011 is in full force and effect for all lands given that no active appeals of this instrument remain.
AND THE TRIBUNAL FURTHER ORDERS that it may be spoken to should a matter arise in connection with the implementation of this Order.
