WHEREAS THE TRIBUNAL has received appeals by Six Nations of the Grand River against Official Plan Amendment 42 and 45 in the City of Kitchener;
AND THE TRIBUNAL having initiated a motion to determine the validity of the appeals and directed that the motion be considered by video hearing on April 2, 2026;
AND THE TRIBUNAL having received a request from the Ministry of Municipal Affairs and Housing for an adjournment of the motion for approximately two months to allow without prejudice discussions;
AND THE TRIBUNAL having received responses from the City of Kitchener, Activa Holdings Inc. and 2517293 Ontario Inc. supportive of the adjournment, but 2517293 Ontario Inc. requests the motion to be dealt with as expeditiously as possible if the settlement discussions prove unsuccessful;
NOW THEREFORE:
THE TRIBUNAL ORDERS THAT:
The Hearing of the Motion is adjourned;
The Parties are to inform the Tribunal by no later than April 24, 2026 whether a complete settlement has been reached;
Failing a complete settlement, the motion is set down for a hearing on:
