MEMORANDUM OF ORAL DECISION DELIVERED BY C. HARDY ON FEBRUARY 18, 2026 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This was the first Case Management Conference (“CMC”) conducted in these proceedings concerning appeals brought by EMTC Holdings Inc. (“Appellant”) pursuant to ss. 22(7) and 34(11) of the Planning Act, R.S.O. 1990, c. P.13, as amended (“Act”), relating to the City of Mississauga’s (“City”) non-decision with respect to the Appellant’s applications for an Official Plan Amendment (“OPA”) and Zoning By-law Amendment (“ZBA”). The applications pertain to lands municipally known as 5100 Erin Mills Parkway, in the City (“subject property”).
2At the commencement of the CMC, counsel for the Appellant provided a helpful overview of the applications and the proposal. The subject property is currently improved with low-rise commercial buildings. The proposed development would be located on the northwest quadrant of the Erin Mills Town Centre mall site and includes residential tower-on-podium buildings of varying heights, surface and below-grade parking, a public park, and a new urban plaza. The OPA and ZBA were filed with the City on October 31, 2024, and deemed complete in January 2025. The Appellant appealed the City’s failure to render a decision on the applications in November 2025.
3The Tribunal confirmed with the Parties that there were no concerns consolidating the OPA appeal (OLT-25-000906) and the ZBA appeal (OLT-25-000907). The Tribunal ordered consolidation of the appeals, which will proceed under Tribunal File No. OLT-25-000906.
CONFIRMATION OF NOTICE
4The Tribunal confirmed with counsel that there were no known issues with service of Notice of the CMC, and as such, no further notice is required. The Tribunal received the Affidavit of Service of Daniel Teichman, sworn on January 30, 2026, which was marked as Exhibit 1 to the CMC.
STATUS REQUESTS
5In advance of the CMC, the Tribunal received one written request for Party status from Peel District School Board (“PDSB”), which was marked as Exhibit 2.
6In its written status request form, PDSB noted concerns regarding whether the applications had regard to the adequate provision and distribution of educational facilities in accordance with the Act and the Provincial Planning Statement, 2024. At the CMC, counsel for PDSB submitted that a new school site would be required in the proposed development given the current capacity and the anticipated yield from the proposal. On consent of the Parties, the Tribunal granted PDSB status as a Party to the appeals.
7In addition, the Tribunal received 13 written requests for Participant status, which were collectively marked as Exhibit 3. The written Participant status requests were received from the following individuals:

- Xiao Ya Zhou;
- Hong Sun;
- Jin Hee Choi;
- Ka Wai To;
- Yanwen Ji;
- Yuxin Tian;

8The concerns raised by the requestors had common themes, including the anticipated strain on infrastructure and existing schools, traffic congestion, pedestrian safety, access to sunlight, and privacy.
9The Tribunal, having reviewed the Participant Status Request Forms and any information contained therein, is satisfied that the requestors have an interest in these proceedings and raise concerns that warrant consideration by the Tribunal. On consent of the Parties, the Tribunal granted each of the individuals listed in paragraph [7] above status as a Participant in the appeals.
10At the CMC, Ed Clements advised the Tribunal that he was seeking Participant status in the proceedings and was not aware of the requirement to file a written status request. On consent of the Parties, the Tribunal granted Mr. Clements provisional Participant status contingent upon his filing a written status request with the Tribunal following the CMC. Mr. Clements subsequently complied with this request.
11The Tribunal noted to those present that repetition does not bolster the merit of an argument nor does the Tribunal place more weight to a concern based on the number of times that it is raised. As such, for the purposes of efficiency, and to avoid repetition, the Tribunal encouraged the Participants to work together on and consider filing a joint statement that captures any common concerns.
OPPORTUNITIES FOR SETTLEMENT / MEDIATION
12Counsel for the Appellant advised that the Parties are actively discussing mediation and intend to pursue private mediation following the CMC. PDSB was included in the discussions in anticipation of it becoming a Party to the proceedings.
PROCEDURAL ORDER AND HEARING DATES
13In advance of the CMC, the Appellant filed a draft Procedural Order with the Tribunal, which included an outline of the issues that the City would be raising. Counsel for PDSB submitted that some of its issues aligned with those of the City and the remainder were in the process of being finalized.
14The Tribunal set the following timeline for the Parties with respect to the circulation and filing of a final draft Procedural Order:
a. the City and PBSB will provide the Appellant with each of their lists of issues on or before Wednesday, March 4, 2026; and b. the Appellant will file a revised draft Procedural Order with the Tribunal for review and approval on or before Wednesday, March 11, 2026.
15The Tribunal Member will remain available, schedule permitting, to assist if any issues arise in finalizing the draft Procedural Order.
16Counsel for the Appellant requested the scheduling of a second CMC to review resolved or scoped issues and address any other procedural matters. The Tribunal agreed that a second CMC would allow the appeals to proceed efficiently and scheduled a second CMC on Monday, August 24, 2026.
17The Parties jointly requested that the Tribunal schedule a 20-day hearing to proceed in March 2027. Following consideration of the Parties’ submissions, the Tribunal agreed with the requested length of hearing and scheduled a 20-day hearing to commence on Monday, March 22, 2027. The Tribunal will not be sitting on Friday, March 26, 2027, Monday, March 29, 2027, and Monday, April 5, 2027.

23As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.

24THE TRIBUNAL ORDERS THAT Tribunal File No. OLT-25-000906 and Tribunal File No. OLT-25-000907 are consolidated and will proceed under Tribunal File No. OLT-25-000906.
25THE TRIBUNAL FURTHER ORDERS THAT:
a. Peel District School Board is granted Party status in the proceedings; b. The following individuals are granted Participant status in the proceedings: i. Tian Yang; ii. Jing Yang; iii.
