UPON APPEAL having been brought by Upper West Side Landowners Group Inc. (“Applicant”) to amend the City of Hamilton (“City”) Urban Official Plan with respect to lands bounded by Twenty Road West, Upper James Street, Dickenson Road, and Glancaster Road.
AND THE TRIBUNAL marked as Exhibit 1 the Affidavit of Service attesting to proper Notice having been given for this Case Management Conference (“CMC”) and proceeded to conduct a CMC on February 17, 2026, held by videoconference;
AND THE TRIBUNAL, on consent of the Parties, granted Participant status to:
Elfrida Community Builders Group Inc. (“Elfrida Group”);
Hamilton Wentworth Catholic District School Board;
Six Nations of the Grand River Elected Council;
Benita Badke; and
Maria Vallera;
It was highlighted that both the Applicant and the Elfrida Group each have other on-going private appeals relating to changes to the City’s urban boundary. Per discussions between the Applicant and the Elfrida Group, should the Elfrida Group be successful in their private appeal, it was agreed that they would withdraw the Participant status request for this file;
AND THE TRIBUNAL confirmed the Parties’ awareness of Tribunal-led mediation;
AND THE TRIBUNAL, at the CMC, scheduled a second CMC to commence on Friday, May 22, 2026 by videoconference;

The Parties are directed to submit the draft Procedural Order by Wednesday, May 13, 2026; and
