INTRODUCTION
1This decision and order relate to the ninth Case Management Conference (“CMC”) for Tribunal File Nos. OLT-22-002220/OLT-22-002221, in relation to several appeals pursuant to ss. 17(24) and 34(19) of the Planning Act (“Act”) against the decisions of the Town of Fort Erie (“Town”) to adopt Official Plan Amendment No. 56 (“OPA 56”) and Zoning By-Law Amendment (“ZBA”) No. 144-2021 (“ZBL No.144-2021”). OPA 56 is also known as the Crystal Beach Secondary Plan, and the lands subject to this amendment cover an approximate area of 359.4 hectares.
2There are only two remaining appellants in this matter, namely 1000054526 Ontario Inc. (formerly 1609652 Ontario Ltd) and 3101669 Nova Scotia Company (“Appellants”).
3The Tribunal also convened the first Case Management Conference for Tribunal File Nos. OLT-25-000615/OLT-25-000616, which are site-specific appeals that are related to OLT-22-002220/OLT-22-002221 and were received by the Tribunal in September 2025.
4The Tribunal received and marked the Affidavit of Service sworn November 18, 2025, attesting to proper Notice having been given for this CMC for the new site-specific appeals, OLT-25-000615 and OLT-25-000616, as Exhibit 1. The Tribunal did not receive any Party or Participant status requests in advance of or at the CMC.
5Counsel for the Appellants, Mr. Tom Hanrahan, requested that the new site-specific appeals be heard with OLT-22-002220/OLT-22-002221, with the site-specific appeals proceedings first. Counsel for the Town did not oppose this request.
6In order for the Parties to have time to prepare the Procedural Order and Issues List, this matter was previously scheduled for a further CMC on Tuesday, January 27, 2026, which was subsequently adjourned to February 27, 2026.
7The further CMC is scheduled to proceed by video on Friday, February 27, 2026 at 10 a.m.

ORDER
13THE TRIBUNAL ORDERS THAT:
The Parties shall file with the Tribunal the draft Procedural Order and Issues List 10 days in advance of the next Case Management Conference;
The appeals (OLT-22-002220, OLT-22-002221, OLT-25-000615, and OLT-25-000616) shall be heard together, with the site-specific appeals (OLT-25-000615 and OLT-25-000616) proceeding first.
This Member is not seized.
