MEMORANDUM OF ORAL DECISION DELIVERED BY STEVEN T. MASTORAS ON FEBRUARY 18, 2026, AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This matter is a second Case Management Conference (“CMC”), resulting from appeals under sections 22(7) and 34(11) of the Planning Act (“Act”), in the City of Vaughan (“City”), for the City’s failure to adopt the requested Official Plan Amendment application (“OPA”) and the City’s refusal or neglect to make a decision regarding a Zoning By-law Amendment (“ZBA”) application (together “Applications” / “Appeals”).
2The Appeals were submitted by 2371933 Ontario Inc. (“SKY” / “Appellant” / “Applicant”) for lands municipally known as 7520, 7540, and 7560 Weston Road (“Subject Lands”). The Applicant is proposing a development consisting of two (2) mixed-use residential buildings with proposed heights of 42 and 45 storeys respectively, supported by a four-storey podium with a total of approximately 952 residential units, and 734.88 square metres of ground-floor commercial space, all serviced by 824 parking spaces and 670 bicycle parking spaces. The proposed development has an FSI of 8.76 (“Proposal”).
3A single Participant was conferred status at the first CMC, on January 28, 2026, noted as Gallu Construction Inc. (“Gallu”). At this second CMC, Kingsmoor Developments Inc. (“Kingsmoor”), as represented by Paul DeMelo, appeared to request Participant status with these Appeals. There were no objections or concerns from either the Appellant or the City, and, therefore, Participant status was conferred to Kingsmoor, in relation to these Appeals.
REQUEST FOR MERIT HEARING
4SKY is seeking the scheduling of a Merit Hearing at the Tribunal’s discretion at some time in the Fall of 2026, for approximately ten (10) days.
5At a recent Hearing, a Motion for Direction (“Motion”) request from the City was granted, in part, with a Decision from this Tribunal Member (Issued February 17, 2026), allowing for a related Phase 1 Transportation Hearing (“P1TH”) expected to deal with the commonality of issues that exist with this Appeal, and three other appeals, currently before the Tribunal. P1TH is scheduled to commence for up to ten (10) days, beginning on Monday, August 10, 2026. The other Tribunal Case Nos. include OLT-25-000288, OLT-25-000892, and more recently, OLT-26-000088 (together the “P1TH Parties”).
6Matter OLT-25-000288, is scheduled to commence its Merit Hearing on Monday, October 26, 2026 (for ten days), and the other two matters above are awaiting CMCs, respectively, that will address their Site-Specific matters, in the course of their own Merit Hearings, subject to the Tribunal’s calendar.
TRIBUNAL DIRECTIONS
7After careful consideration of the Tribunal’s calendar, and those of the Parties involved with these SKY appeals, the Tribunal directed that a Merit Hearing shall be scheduled to commence on Monday, November 30, 2026, to Friday, December 11, 2026, for a total of ten (10) days, beginning at 10 a.m. by video conference.

12As of March 30, 2026, all hearing events are governed by the Tribunal’s Artificial Intelligence Practice Direction. This Practice Direction requires a party, participant, or witness to include a declaration within each submitted document if generative AI was used to create or generate content.
13The Tribunal also directs that the Parties shall submit a draft Final Procedural Order and Issues List to the Tribunal, on or before Tuesday, April 7, 2026, for its consideration and approval that will serve to guide the Merit Hearing process as scheduled above.
14Finally, the Tribunal was appreciative of the respectful cooperation between Counsel for all of the Parties present and are reminded of the availability of Tribunal-led mediation, at the appropriate time on consent of the Parties.
ORDER
15THE TRIBUNAL ORDERS THAT:
In the matter of appeals from 2371933 Ontario Inc., against the City of Vaughan, a Merit Hearing is scheduled to commence on Monday, November 30, 2026;
All other directions in this Decision are so ordered.
16The Member is not seized on this matter, however, is available to assist if anything is required from the Parties.
17There will be no further Notice.
