THESE MATTERS involving appeals, under subsections 22(7) and 34(11) of the Planning Act, R.S.O. 1990, c. P. 13, as amended, regarding the failure of the City of Toronto to make a decision in respect of planning applications for amendments to the City of Toronto Official Plan (“OP”) and City of Toronto Zoning By-law No. 596-2013, as amended (“ZBL”), having come before the Tribunal for a written hearing to consider a settlement proposal proffered on consent of the Parties on December 4, 2023 and January 24, 2024, and the Tribunal having received and considered expert planning opinion evidence in support of said settlement, and the Tribunal having allowed the appeals in part, by way of an Interim Decision issued on February 26, 2024;
AND THE TRIBUNAL having received a request on consent of the Parties advising that the pre-requisite conditions, set out in the Tribunal’s Interim Order issued on February 26, 2024, have now been satisfied;
AND THE TRIBUNAL having received and considered supplemental expert planning opinion evidence in the form of an Affidavit of Graig Uens dated December 23, 2025;
AND THE TRIBUNAL FINDS THAT the proposed development, to be facilitated by way of the proposed amendments to the OP and ZBL, continues to constitute an efficient use of land, being located on an Avenue and a major street in a Protected Major Transit Station Area (“PMTSA”) and Secondary Plan Area, and near community facilities and parks, as well as a range of commercial uses, and that the proposed revisions will ensure that the redevelopment will continue to fit appropriately in its context and addresses the City’s various growth, urban design, and housing priorities, and that the proposed development is consistent with the Provincial Planning Statement (2024), conforms with the City of Toronto Official Plan, and represents good planning and is in the public interest.
NOW THEREFORE, THE TRIBUNAL ORDERS THAT:
The above-noted appeal pursuant to subsection 22(7) of the Planning Act is allowed, in part, and the City of Toronto Official Plan is hereby amended in the manner set out in Attachment “1” to this Final Order.
The above-noted appeal pursuant to subsection 34(11) of the Planning Act is allowed, in part, and the City of Toronto Zoning By-law 569-2013, as amended, is hereby amended in the manner set out in Attachment “2” to this Final Order.
The Tribunal authorizes the municipal clerk to format, as may be necessary, and assign a number to the by-laws included in Attachments “1” and “2” to this Final Order for record keeping purposes.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”).
